...2/11/2014 Buad 455 Letter to the Editor The “I Have a Dream” speech is one of the most powerful, popular speeches of all time. This historic speech touched on many different theories and issues occurring in society. On august 28th, 1963, in this speech Dr. Martin Luther King Jr. called for racism in the United States to end. He spoke his word to over a quarter of a million individuals in attendance. In this speech, Dr. King referenced the Declaration of Independence, the Emancipation Proclamation, and the United States Constitution. In this article, Bill Moyers personally reflects on this speech. In this reflection, Bill Moyers states, “You can see why we need to reclaim the economic vision of both Abraham Lincoln and Martin Luther King, Jr.” I completely agree with Mr. Moyers on this statement, America’s economy is currently in poor standing and something needs to be done. Moyers explains how equal opportunity amongst races is in danger for working people by stating, “In our time, this idea of universal opportunity is once again under assault for working people of every race.” Lower and middle class citizens are at a complete stand still with incomes, the level of individual using food stamps and government assistance is at an all time high, and more then 40 million people are living in poverty. To add to that despair more then 30 million people are unemployed. The economy is worse now than it has been in the past, the productivity level of workers has increased while...

...Employment at Will Doctrine Kristen Harrison Leg 500 February 4, 2014 Elaine B. Wilson EMPLOYMENT AT WILL DOCTRINE The Employment at Will Doctrine The employment at will doctrine was developed in the late nineteenth century, as a default employment contract which was assumed to give employers and employees equal ground to develop wages, benefits, and employment agreements. The employment at will doctrine continues to prevail in all American jurisdictions except Montana. An employer can terminate an employee for a good reason, a bad reason, or no reason at all (Bagenstos, 2013). The employment at will doctrine is void if reason states that it is specifically forbidden by some external source of law, such as an antidiscrimination statue (Bagenstos, 2013). Employees formed unions during the industrial revolution, in order to toughen their negotiating power against large corporations, which fired employees at will to keep labor cost low and profits high (Muhl, 2001). Before employees formed unions the working conditions were unethical, and favored the employer who could fire the employee at will (Muhl, 2001)The 1960’s was where Federal legislative protections started to play a major part in protecting employees. Title VII of the 1964 Civil Rights Act put a damper on the unethical treatment of employees by their employers. The Federal legislation protected employees from illegal discharge based on...

...Financial Statement Insurance This is a proposal to increase the effectiveness of corporate governance in the post-Enron era through the implementation of financial statement insurance. This paper gives a brief history of the purpose of financial statements as well as the importance of external auditing of financial statements. It gives examples of the corporate governance failures of companies like Enron and WorldCom. It covers how and why these failures happened and reviews the grave consequences of the failures. It also takes a brief look at the laws that have been passed to prevent future failures, such as the Sarbanes-Oxley act of 2002. It shows how the new laws have been helpful but have not solved the problem. Finally, it shows how the implementation of financial statement insurance will greatly improve the accuracy of external auditing of a company’s financial statements. Purpose of financial statements The purpose of financial statements is to give an overall picture of the health and profitability of the business. This overall picture of the business provides information on a company’s financial position and performance. Financial statements are also necessary to show changes in a company’s financial position. Financial statements are used internally by managers, shareholders and employees to make good business and investment decisions. They are used externally by prospective investors, financial institutions, suppliers, customers, competitors, and governments...

...Assignment 2: Employment at Will Doctrine LEG500 Legal, Ethics and Corporate Governance August 3, 2014 Referring to the Employment-At-Will doctrine, which states that both employer and employee can terminate their relationship as employee and employer for good cause, for no cause, for cause morally wrong or for no cause at all, some of these employees seems to have crossed the line that gives all the possible reason for the company to fire them (Halbert & Inguilli, 2012, pg 46). Considering that the company operates, as any at will employer it can be assessed that it has the full authority to terminate most of these employees since they have committed a breach of contract with their actions. However, even though the doctrine gives the absolute right for both stakeholders to terminate their contract for a cause or for no cause at all, there are still some limitations to the law that companies need to consider before firing an employee if they wish to minimize their liabilities and litigation costs. If there's no contract covering termination, you're free to fire an employee at any time, for any reason or for no reason at all. That law still applies today, but the "at-will" rule is subject to many limitations. For example, despite the "at-will" rule, a fired employee may claim one or more of the following grounds in a wrongful-discharge case (Steingold, 1997, para 4)). In light of this I will try to assess the actions of these employees one by one to determine the appropriate...

...Employment-At-Will Doctrine Sherita Pittman October 26, 2014 Master of Business Administration LEG 500 Strayer University Employment and employee go hand and hand at some point in life. Work is defined as, exertion or effort directed to produce or accomplish something; labor; toil and employment is, an occupation by which a person earns a living; work; business (Dictionary.reference.com (2014). As the Chief Operating Officer (COO) in a midsize company preparing for an Initial Public Offering (IPO). I have discovered multiple personnel problems that require immediate attention and faced with difficult decisions to be made. In this paper I will discuss the employment-at-will-doctrine and examine three scenarios described, analyze whether legally I can fire the employees by including an assessment of any pertinent expectations to employment-at-will doctrine, the primary actions I should take to limit liability and impact on operations and examine the state’s policy on employment-at-will by analyzing one real-world example of an employee or employer utilizing state’s employment-at-will doctrine in the last five-year. As an astute manager, I have analyze the employment-at-will doctrine and determine what, if any, exceptions and liabilities exist before taking any action. As I proceed with the investigation, I discover the company has no whistleblower policy. The employment-at-will doctrine is the legal doctrine that gives employers a broad discretion to fire employees...

...Decline of Democracy in America The founding fathers didn’t create a democracy because they thought it would work perfectly. They didn’t give people the right to vote so that everyone would find true happiness. They knew better than to create a utopia where everyone had their own white picket fence, went to church on Sunday and lead lives as model citizens. They understood that toes would get stepped on, feelings would get hurt and sacrifices would happen. The founding fathers didn’t start a revolution to make people happy, they started a revolution because they believed in the idea that everyone had the right to equality. They founded America on the belief that hard work will lead to prosperity in the land of opportunity. All the ideas we associate with America: capitalism, the free market, education, elections, these all came about because people wanted to have power over where their life took them. Being able to make decisions in your own interest: the founding fathers based America on that principal, and they structured the government so it would protect those interests. Today, this is not the case. Although it may appear that America has come a long way since the civil and women’s rights movement, increasing inequality and discrimination in the 21st century has created a democracy that no longer represents the interests of its constituents but its ruling elite. Despite people’s preconceptions that our society represents...

...How Europeans View Americans: Whether or not I agree with the author is based on my beliefs and experience with different economic factors. Although this article is opinionated of how the author shares different experiences from different Europeans frames (points of view) of the American society, we should all note that this is not the consensus for all Europeans. In reference to the matters that persuaded the United States to utilized their military might (September 11 2001), are only the actions of the current administered, which resulted in a ripple effect that cast judgment on all the American population. Although determined, the Bush administration left their allies on the sideline; where they felt obligated to respond and defend the homeland, which clearly displayed one difference in the U.S. and European view of security. In the summer of 2002 in an article Policy Review by Robert Kagan, he stated, “ It is time to stop pretending that Europeans and Americans share a common view of the world, or even that they occupy the same world” (Gordon, P. H, 2003). Cultures and generations have enforced and reinforced the values and belief systems that either population (American and European) have passed down from generation to generation to their children. Although Robert Kagan shared his views in the article, it is safe to say his perceived structure is not destiny, but should not be ignored. (Gordon, P.H. 2003). Apart from many other differences, which differentiate the...

...Organizational Behavior Kofi Osei Tutu Law, Ethics & Corporate Governance: Employment At Will Doctrine Dr. Meredith Brasca February 2, 2014 Employment-at-will [EAW]: “when an explicit agreement of contractually binding terms of employment is absent, the employment relationship exists only so long as both parties will it to continue. That is, either party is free to end the relationship at his or her will. Moreover, the relationship may be terminated at any time and for any reason. United States employment law has traditionally been governed by this doctrine. One of the most widely quoted expressions of this doctrine comes from a case heard before the Tennessee Supreme Court: Payne v. Western & Atlantic R.R. Co. (1884). The majority opinion in the case reads in part: John posted a rant on his Facebook page in which he criticized the company’s most important customer. As an employer, I do not have legal grounds to fire John. Since this is John’s first offense, I will reprimand him by giving him a warning. I am supporting this action with the utilization of the exception “implied contracts of employment”- this simply states: “We do not dismiss employees without giving them a chance to correct their behavior.” However, I will make adjustments to our company’s policy in our handbook to cover this type of behavior. He depicted a very negative image of our company with his ranting on social media, and that will be listed as a violation of our code of conduct...

...Final Paper Introduction In this paper we will be exploring and analyzing the disciplines of business communication and organizational leadership. In regards to these disciplines we will be looking at their history, three bachelor’s degree programs, 3 masters programs, hot topics in these fields and also be looking at peer reviewed articles in these fields. We will also use these disciplines to investigate the real-world challenge of the gender pay gap by using existing peer-reviewed literature of Business Communication and Organizational Leadership. “Some scholars see business communication as a hybrid discipline with broad theoretical traditions in rhetorical theory, communication theory and management theory making business communication the intersect of such (Shaw, 1993: Smeltzer, Glab & Golden, 1983); while other argue that to identify the field of business communication the conceptual problematic underlying its intellectual inquiry should be examined, rather than by its instructional practices or vocabulary (Murphy, 1988). It seems that research on this subject started in 1993 with Dulek, R.E. 1993). Models of development: Business school and business communication, there are also text book themes that have emerged from 1910 to 1974. Familiar items that have emerged are: human relations and consumer behavior” In order to get a business communication degree from ASU a person must take an array of different courses. ...Nick Saban If Nick Saban were running a company instead of a football program, he would be a top manager. Alabama football is big business, and it will continue to get bigger under Saban. “In 2006, the year before he arrived in Tuscaloosa, the athletic department brought in $67.7 million in revenue, mostly from football, and spent $60.6 million. Last year revenue was $124.5 million and expenditures were $105.1 million -- leaving a $19.4 million profit, according to figures compiled by USA Today. During Saban's tenure, Alabama has expanded the capacity of Bryant-Denny Stadium from 92,000 to 101,000, including the addition of new luxury (i.e., more expensive) seating”(O'Keefe, 2012). It was an obvious decision for the school to give him a two-year contract extension along with a significant raise earlier last year. With a salary package that averages $5.6 million a year over the next eight years, Saban is among the highest paid coaches in college football. “Nick Saban, the undisputed emperor of college football, has everything he could ever want in Tuscaloosa: Three national titles in four seasons; a great shot at another one a year from now; the best players; no static from anyone, including the browbeaten reporters who cover him; and the whole world kissing his feet”(Silver, 2013). Nick Saban is no doubt one of the best college football coaches in America. His passion, work ethic, persistence, and humility have got him to where he is today. These characteristics started when...
