He sets aside what most people would think of as ‘constitutional law’. He is not interested in discussing topics of major debate, calling them the ‘constitution of conversation,’ but rather, wishes to discuss those topics which have already been, for the most part, settled, aptly called the ‘constitution of settlement.’ Topics such as whether Congress should be a bicameral legislature, or whether judges should be appointed for life, or whether the electorate should be able to vote on constitutional amendments. Topics that are not questions of interpretation, but rather, questions of the wisdom of the structural decisions of the Constitution itself, most of which were made way back during the Philadelphia Convention. His purpose in doing so is not so much to answer questions, but rather to ask them. He seldom gives his own positions on the questions that he asks - more so, he wishes to open up the public’s mind about such questions. Jeremy Bentham thought the very expression to be a ‘paradoxical and unmeaning epithet’.[1] In his view, social reform required ‘fixed and accurate’ laws—laws that ‘[w]e see, we hear, we touch; in short we handle…’[2] This empirical concept of law follows from the ideal of law as something produced by conscious acts of sovereign will. Central to this concept are, to use H.L.A. In this article, we explore the connection between these variables and suggest the outlines of a model that can integrate them in a coherent way. This depends on linking a consensus-based microlevel of network with a conflict-based macrolevel of social class. We suggest interpretations of certain sociolinguistic findings, citing detailed evidence from research in Northern Ireland and Philadelphia, which emphasize the need for acknowledging the importance of looseknit network ties in facilitating linguistic innovations. We then propose that the link between network and class can be made via the notion of weak network ties using the process-based model of the macrolevel suggested by Thomas Hejrup's theory of life-modes.
