Key facts:

In case 36, Bruce Carson is designing a road between two large cities in an unspecified state. He determines that the shortest route to construct the road would be through the land and farmhouse of the Jones family. The farm has been in the Jones' family for 150 years. The building the road using the route though the farmhouse would reduce the commute time between cities to one hour forty minutes from a two hour drive. The owner, Robert Jones, is 63 years old and was raised on the farm and has lived in that farm house his whole life. He is not willing to sell the farm for any amount of recompense. However, Bruce thinks that he can have the state acquire the land using "eminent domain".

If one uses the Rights Approach of the respects for persons model, the Jones' have the right to not have their home stolen from them. Although they would be compensated monetarily, they could not be compensated emotionally. It would be legalized theft to force them to sell their cherished home against their will. They also have the right to property, the right to not be disrespected, the right to free action, all of which are violated if the state forces them to sell their home. Additional information such as the environmental impact of the two routes, cost of building the road through or around the farmhouse, or if the farm is failing financially, could potentially improve the case for exercising eminent domain. However, with the information as provided I would advise Bruce to avoid eminent domain and build the road around the farm because exercising eminent domain would violate the Jones' moral
