...LAW CASE STUDY (Topic-2) "The core idea of negligence is that people should exercise reasonable care when they act by taking account of the potential harm that they might foreseeably cause harm to other people.”[1] INTRODUCTION: In this particular case are there many contractual terms that are used. So, to solve this case or before giving any judgement, we need to define these terms and gain sufficient knowledge about them. The first and the most important thing we need to know is: What is a contract? A contract is an agreement which is enforceable by the court of law. For a legal contract there has to be an offer and its acceptance. “Acceptance occurs when the party answering the offer agrees to the offer by way of a statement or an act. Acceptance must be unequivocal and communicated to the offer or the law will not deem a person to have accepted an offer merely because they have not expressly rejected it. Some modifications to the rules of offer and acceptance have been made to protect consumers by sections 18 and 41 of the Competition and Consumer Act 2010 (Cth) schedule 2 Australian Consumer Law (“ACL”) for example, invitations or offers to purchase cannot be misleading or deceptive.[2] Thus acceptance is a very important concept of contracts. Generally a valid contract has acceptance. The different types of contracts are: Formal Contracts and Simple Contracts. “A simple contract can be totally written, partly written and partly “oral” (verbal), or totally oral...

What I meant by significant event is an event that events that were sufficiently great or were important and created pathways for change to occur. Back in these time black African American were being treated as second class citizens and where seen as ‘separate but not equal’. However there were events that changed these views such as the Brown Vs Topeka Board of education, The Little rock high school case, the James Meredith Case and also the Montgomery bus boycott of 1955 that sprung into action after one several people began to stand up to the unequal laws that had been set. ...segregation laws that existed in the southern states of the US during the 50s and 60s. It involved the ordinary black people of Montgomery and was the first time that ordinary black people took part in the challenge to discrimination against black Americans. The NAACP (National Association for the advancement of coloured people) and CORE (Congress of racial equality) worked away quietly for many years beforehand fighting in long court battles to end segregation but the Montgomery protest, although fought in courts, was massively supported on the streets. Jo Ann Robinson of the Women’s League and E.D Nixon of the NAACP set up the MIA (Montgomery Improvement Association) which not only organised and lead the boycott of the buses but continued with peaceful protests despite harassment form white racists. Support increased as people approved of the non-violence in the protests. The MIA was of great pride across the US and the popular public opinion expressed on the streets was of great inspiration to black people who then went out and organised themselves in the towns and cities like that of Montgomery which launched the modern civil rights movement. The black churches and religious leaders gathered from across the southern states and formed the SCLC (Southern Christian Leadership Conference) to fight for civil rights for blacks by means of marches, demonstrations and boycotts. The black churches and leaders played a vital role in the Montgomery bus boycott. The MIA was allowed...

...Levendary Café What is your evaluation of the way Levendary Café has entered the China market? As the newly named CEO, Mia Foster faced enormous challenges in assuming duties from Howard Leventhal, the founder and departing CEO of the popular Levendary Café brand. As a first-time CEO who lacked international management experience, she took the reins of a 3,500-unit, $10 billion business during the midst of a transitional period of expansion into the China market. In 2008 Levendary’s domestic growth had slowed and the company recognized the opportunities the Chinese market could offer. With its rising population, continually growing GDP, and a strong middle class consumer behavior that mirrored Levendary’s domestic formula for success, Foster realized that managing Levendary’s entry into the Chinese growth market would be key to the company’s long term growth and success. This move, however, was met with skepticism from Wall Street and many of Levendary’s corporate staff who held concerns that the company's major expansion into China involved moving too far from Levendary's well-defined concepts of store design and menu. The Levendary brand had a strong track record, but investors as well as internal staff had strong reservations regarding Levendary’s current domestic financial position and that, coupled with Foster’s lack of international experience, caused the Levendary stock to trade at a market discount (Bartlett, 2013). Levendary’ entry strategy into the Chinese market...

This led to the community organising a car pool which carried many of the passengers the buses would have carried, this showed great community spirit and how powerful people working together could be. ...Race ******** ETH/125 February 23, 2014 Charmagne Quarles Historical Report on Race In this chapter of our reading, we will discuss the history of the African Americana experience in the United States. We will evaluate political and social issues that have impacted the African American Community. This chapter will also introduce groups and organizations that opposed legislation that led to discrimination and promoted legislation that removed discrimination. The plight of discrimination that African Americans have received began almost immediately upon arrival in the United States. In 1660, while still under British rule, laws were passed that made African Americans slaves for life (Schaefer, 2012). These laws led to the development of what was known as "slave codes." Schaefer (pg. 177) defines slave codes as "laws that defined the low position held by slaves in the United States." According to Schaefer (2102), these codes were used as racial formation to solidify the African Americans as an inferior race. Slavery was eventually abolished after the Civil War but this abolition did not increase the standing of the Black Community. Schaefer (pg. 177) theorizes that slavery set the foundation for the problems with racial equality that we face today. After the Civil War, the African American community did not become the equal American citizens they imagined they would become. Segregation became common practice after the Reconstruction period that followed...
