nursing assistant was simply following an order given by the nurse. The health care team has a duty to fulfill the written orders by a doctor and the care of this patient was compromised. The facility did not have the proper accommodations for this patient and failed to notify the ordering physician. This case falls under the doctrine of “respondeat superior” the facility is liable for the events of this case and the employer is liable for the consequences of the certified nursing assistant’s action. The physician had an obligation to the patient to ensure that the treatment plan was followed correctly.
