...Journal of Intellectual Property Rights Vol 18, September 2013, pp 457-464 Piracy in the Internet Age Nikita Hemmige† ILS Law College, Law College Rd, Pune 411 004, India Received 17 December 2012, revised 12 August 2013 The Internet has created boundary-less territories and has helped in evolving a unique method to share and transfer information, growth of e-commerce and in creating a global platform for all nations and its citizens. Online piracy is a major flipside to this development. Rampant intellectual property (IP) infringements by way of unlawful reproduction and unmonitored downloads is a matter of concern. It is significant to take note of the laws that various countries have enacted and enforced in order to curb or at least regulate online piracy and related activities. Further, though the Copyright Act, 1957 and Information Technology Act, 2000 in India deal with certain facets of piracy, they do not conclusively deal with this menace. It is the need of the hour for India to draft and enforce laws which will address the current problem and also take into consideration the technological advancements that are likely to give rise to more of such complex issues. Formulating such a law in the near future will be a welcome change and will definitely give India the IP advantage. Keywords: Online piracy, copyright infringement, jurisdictional barriers, Internet laws, intellectual property The Internet has become the first port of call for anyone in search...

...to $3.5 Billion a year to pirated video games. The losses to piracy are equal to about one-fifth of the total value of the video game market (De Weck, 2012). This figure is, of course, a simple estimate as no hard data is available to determine the true value of the losses. However, Industry sources report that in 2005, U.S. retail sales of video game software was $7.0 billion, rising to $7.4 billion in 2006 (Siwek, 2007). These figures indicate a rather substantial decrease in loses that may have a correlation with the economy as well as the decrease in sales. Another niche within the Entertainment industry that is heavily affected by piracy is the Music Industry ("Who music theft," 2012). To put this problem in perspective how devastating piracy not only to the Gaming Industry, a study by the Institute for Policy Innovation that dates back to 2007 had determined that the accumulative impact of millions of songs downloaded illegally amounts to an annual harm of around $12.5 billion dollars in losses to the U.S. economy as well as more than 70,000 lost jobs and $2 billion in lost wages to American workers (Siwek, 2007). The negative effect that piracy has in the gaming industry is a global effect. In 2011, the Arabian Anti-Piracy Alliance pointed to a recent report published by AM Mindpower Solutions, which disclosed that at least 73% of actual global revenue from video gaming is lost every year due to piracy with rates increasing while total revenues decrease (Butler,...

...Week 1 Assignment Software piracy is the illegal copying, distribution, or use of software. It is such a profitable "business" that it has caught the attention of organized crime groups in a number of countries. When you purchase a commercial software package, an end user license agreement ( EULA) is included to protect that software program from copyright infringement. Typically, the license states that you can install the original copy of software you bought on one computer and that you can make a backup copy in case the original is lost or damaged. You agree to the licensing agreement when you open the software package (this is called a shrink wrap license), when you open the envelope that contains the software disks, or when you install the software. 2 organizations that that work to prevent software piracy is SIIA and FAST. The Software & Information Industry Association (SIIA) is a trade organization for the software and digital content industry. SIIA offers global services in business development, government relations, corporate education, and intellectual property protection to companies. It also advocates a legal and regulatory environment that benefits the entire industry. The Federation Against Software Theft was set up in 1984 by the British Computer Society's Copyright Committee, and was the first software copyright organization in the U.K. Its first action was to raise the awareness of software piracy and to lobby the U.K. Parliament for changes in the Copyright...

...and be happy. This is exactly what piracy is all about. So what exactly is so wrong with pirating? Piracy of entertainment is illegal and viewed as typically wrong by majority of people. Personally I have saved quite possibly thousands of dollars in pirating in my life. From the days of LimeWire where you could pirate a single song that you would have to download and wait throughout the night for it to be usable. To today where we are able to download whole discographies of artists within half an hour or less. However, today I would like to present you the facts that piracy isn’t as wrong as it appears and how each and everyone in this room can benefit from it by providing information on how it cannot be stopped, the monetary impacts of piracy, and other benefits of piracy. Transistion: Piracy is defined as the illegal trade or copy of digital entertainment according to the Merriam-Webster Dictionary. A study by Portsmouth University in 2014 concluded that the motives for piracy are that it saves money, often helps artists bypass record companies and allows access to content before it’s release date. Body I: Now that we know why people pirate we can look at how Piracy cannot be stopped. A. Goverments have attempted and momentarily succeded to take down pirating websites such as The Pirate Bay, but they revived and came back under multiple new domains within a short period of time B. In 2011 a bill called ‘SOPA’ or STOP ONLINE PIRACY ACT was introduced by US Representative...

...Digital Piracy DIGITAL PIRACY In a day and age when almost all creative works can be put into digital form and legally distributed, there is also a huge potential for theft. This type of theft is known as digital piracy or intellectual property theft and often results in lost revenue, jobs, and wages. Battling online theft is a daily challenge for copyright owners. Digital piracy occurs when creative works such as graphics, photos, movies, songs, or text are distributed online without the consent of the artist, creator, or author and is in direct violation of copyright laws. (Artists Against Digital Theft) These thieves are often referred to as digital pirates. These pirates often setup professional and well-designed websites that trick consumers into believing they are legal. These websites are usually hosted overseas so that digital pirates can avoid requests to remove illegal content. It is very costly and time consuming for copyright owners to pursue international litigation to stop illegal distribution of their creative works. (Artists Against Digital Theft) In an attempt to stop digital piracy, the creative community is uniting together to “champion the rights of artists.” (Artists Against Digital Theft) A website called, Stop Stealing My Future, hosts a contest to help raise awareness about digital piracy. Artists upload videos of themselves explaining how digital piracy affects jobs and the digital arts industry. (Stop Stealing My Future) Another website...

...File Sharing and the Revenue of the Creative Industries Introduction File sharing hosts, who provide online storage to share various files ripped from media like recorded music, films, and books, have been considered as a type of internet piracy that threatens the creative industries, including films, music, software, and books. (Van Eijk, 2011) However, after the shutdown of Megaupload, one of the most popular file hosting site, a series of ripple effect happened, causing several other file sharing hosts either deleted their files, or set up an access restriction. (Peukert and Claussen, 2012) It appeared to be an impact on the internet piracy and the revenue of the creative industries would go up — But it didn’t. According to Peukert and Claussen (2012), for example, the revenue of the film industry have decrease ever since Megaupload’s shutdown. The purpose of the essay is trying to analyze the relationship between the internet piracy via file sharing hosts and the revenue of the creative industries — how does the former interact with the latter — and a solution to resolve the declined revenue of the creative industries. Internet Piracy and File Sharing As its name suggests, “Internet Piracy” refers to manufacturing and distributing unauthorized copies, ie. “pirate copies”, on the Internet. (Panethiere, 2005) While the term “File Sharing” means to share a file with another person physically, such as storing and distributing a file in a CD, DVD, or a drive, or via uploading...

...Introduction The report focuses the controversial topic of SOPA and PIPA. In the report, we will introduce the aims of the two bills and debate whether they are reasonable or not. In the end of discussion, we come to the conclusion that the two should not be passed. Both of the supporter and oppose will provide their reasons. And each of them will attack his/her rival’s argument. The aims of SOAP and PIPA The aim of SOPA The full name of SOPA is Stop Online Privacy Act. It is a United States bill which is attempt by lawmakers to combat online privacy and intellectual property theft. The bill is divided into two sections: “Combating Online Privacy” and “Additional Enhancements to Combat Intellectual Property Theft”. The main aim of SOPA is that give the judicial departments of United States more rights to fight online trafficking in copyrighted intellectual property and counterfeit goods in other areas and other countries. “Combating Online Privacy” attempts to provide tools to law enforcement. “Additional Enforcements to Combat Intellectual Property Theft” clarifies criminal law as applied to intellectual property rights. With the protection of SOPA, lawmakers want to encourage new writings, research, products and services. Because in the old day American inventors, authors, and entrepreneurs have been forced to stand by and watch as their works are stolen by foreign infringers beyond the reach of current U.S. law. As the time goes by, more and more people lose the...

...Digital Media Copyright in Developing Countries In the developing world, piracy is a serious problem. According to the report “Why Poor Countries Lead the World in Piracy”, “Trade reps from rich countries complaining loudly about copyright infringement and demanding that poor countries reorganize their domestic priorities around preventing unauthorized copying at any expense, threatening trade sanctions and worse for the recalcitrant." However, the copyright laws in many developing countries still give little consideration to copyright management issues for Digital Media Fields, such as software, E-book, music downloads, and digital cinema. As the biggest sources of illegal download in the world, developing countries’ digital media technology is seriously hindered. At the same time, some people argued that the tolerant digital media copyright law helps to bring culture and knowledge to people. I believe it is a mistake, as they may not understand Fair Use. In the case of China, according to Liu & Bates, “China copyright law focuses more on the regulations for traditional forms of creative content than the digital fields” (Liu & Bates, 2008). However, according to China Internet Network Information Center’s report, “the number of “netizens” in China has exceeded that of the United States” (2008). At the same time, China has become one of the biggest illegal downloads sources. As a result, China has responsibility to pay attention to digital rights management. A strong...

...Electronic Theft Act Law (NET Act) and implied protection to prevent copying of DVDs have decreased the cases of piracy. However, focusing to dispose unauthorized websites and copyright infringement will not tackle the issue. The movie industry should create new ventures that will attract consumers to find authorized provider of movies. To lessen piracy and avoid the unequal profit distribution, the industry should make a new business design underscoring admission to authorized online streaming sites in an inexpensive and timely manner. The first thing that hurts the economy is the use of unauthorized software and websites to upload and download different movies. This illegal site has taken the profitability of the industry especially in the field of movie production because of the free and illegal access they give to the consumers.
