INTRODUCTION
Recently, Portlandia has a case on all fours with Pena-Rodriguez v. Colorado. The case established that post-verdict jury testimonies that used to be forbidden under Rule 606(b) will be allowed when courts discover racial bias after the verdict. Here are some other reasons why post-verdict testimonies are constitutional and ensures a fair and just trial.

RULE 606(B) GOES AGAINST THE SIXTH AMENDMENT.
The sixth amendment of the constitution sets rights that set rights when it comes criminal persecution. It can be argued that Rule 606(b) is unconstitutional because it violates a lot of provisions that is provided by the Sixth Amendment. The right to have an impartial jury and the right to present a defense/Compulsory Process Clause can be compromised if Rule 606(b) is not set aside when there is racial bias or any other bias contributing to the jury verdict. …show more content…
Juries must be objective and neutral when selected and base their verdict on the facts of the case. However, some jurors can be biased and affect the jury deliberations. Voir dire can screen these jurors to prevent them from being on the jury, but sometimes a juror can lie about their biases to gain a place in the jury. In most cases, the courts find out after the verdict from a member of the juror. Many parties appealing the verdict attempt to use the Rule 606(b) exception to get a juror testimony about racial bias. However, many courts have ruled that Rule 606(b) excludes jury testimony and racial bias does not fit into the exceptions. As a result, defendants do not get an impartial jury or a fair

Pena-Rodriguez V. Colorado Case Study

...Stephanie Ross Professor Rogers PLS 102 04 17 September 2016 Constitutional Issues Paper (Pena-Rodriguez v. Colorado) By definition the 6th Amendment states in all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him (Sixth). When looking into the Pena-Rodriguez v. Colorado case Rodriguez was finding fault with being guaranteed a fair jury. He found this fault because after he was found guilty from the trial two jurors informed Pena-Rodriguez’s counsel that one of the juror’s chosen was making racial statements regarding Pena-Rodriguez and the alibi witness during the...

Moneyball

...Moneyball: The Art of Winning an Unfair Game Michael Lewis For Billy Fitzgerald I can still hear him shouting at me Lately in a wreck of a Californian ship, one of the passengers fastened a belt about him with two hundred pounds of gold in it, with which he was found afterwards at the bottom. Now, as he was sinking-had he the gold? or the gold him? —John Ruskin, Unto This Last Preface I wrote this book because I fell in love with a story. The story concerned a small group of undervalued professional baseball players and executives, many of whom had been rejected as unfit for the big leagues, who had turned themselves into one of the most successful franchises in Major League Baseball. But the idea for the book came well before I had good reason to write it—before I had a story to fall in love with. It began, really, with an innocent question: how did one of the poorest teams in baseball, the Oakland Athletics, win so many games? For more than a decade the people who run professional baseball have argued that the game was ceasing to be an athletic competition and becoming a financial one. The gap between rich and poor in baseball was far greater than in any other professional sport, and widening rapidly. At the opening of the 2002 season, the richest team, the New York Yankees, had a payroll of $126 million while the two poorest teams, the Oakland A's and the Tampa Bay Devil Rays, had payrolls of less than a third of that, about $40 million. A decade before, the highest payroll...
