...In today’s world age, race, and crime are very popular topics. Everyone is accusing each other on their color and race. As a human being I think we should all be treated equally no matter who we are or what’s our background. In the United State African Americans and Latin Americans have a highest rate of crime but, that does not mean if they were all treated equally by the law. Racism is still very much a major part of our society. Growing up in NY I always knew that there were racist people, but I never knew how the racism actually affected our society and how strongly it influences such things as government funding for education and housing developments. Racism and prejudice always seemed secondary to me. I always knew that this country had issues with racism, but I never imagined that it affected serious issues so heavily. Minorities in this country are put at a greater disadvantage than whites. Many minorities, especially those that do not speak English as their primary language, have to deal with inadequate housing, underfunded school districts and the everyday struggle of discrimination for their differences and beliefs. Since the start of the juvenile court in 1899, programs and policies have been implemented. Even with the policies and programs that were implemented to deter juveniles, juvenile crimes are still major social issues within our society. As some research has pointed out, kids who display delinquent juvenile behavior early in their youth stages are at a greater risk of offending within their adolescent years. When it comes to race, crime, and the juvenile justice, violence, substance abuse, and mental health are the three main issues that should be focused upon on when dealing with male and female delinquents. Individualized rehabilitation treatment was a highly recognized policy and practice during the 1970s and 1980s. This model focused on the placement of juveniles, who offended, to be placed in a setting that is community-based and less/non-secure. ...In Heather MacDonald’s article “Distorting the Truth About Crime and Race: The New York Times Is at It Again” she alludes that the New York Times is not keeping the public informed of crime rates. Instead, the Times is more interested with “giving specific racial breakdowns of every aspect of police behavior”(MacDonald). She feels that the New York City Police Department is unable to do their job without having to face allegations of racial disparity. Ms. MacDonald indicates that the reason crime rates are higher amongst minorities than whites is not because of racial prejudices. She says it’s because the vast majority of crimes occur in minority neighborhoods by minority criminals against minority victims. Therefore, this drives police officers to those areas to arrest the individuals committing crimes. In 1994, under the New York Police Department Commissioner William Bratton and Mayor Rudolph Giuliani, the proactive policing revolution began. The idea was to remain visible in so called hot spot areas to help prevent crime from occurring. This gave police officers the authority to question anyone that appeared suspicious. According to MacDonald, due to the implementation of this policy “over 10,000 black and Hispanic males are alive today who would have been dead,” but this type of information does not make front page news. As such the Crime and Disorder Act 1998 was introduced and contained within it the provisions for preventing and criminalising racially aggravated offences. According to section 28 of the Crime and Disorder Act an offence is racially motivated if at the time of committing the offence or immediately before or after, the offender demonstrates towards the victim any hostility based on the victim’s membership or presumed membership of a racial group. Over a decade later, the Equality Act 2010 was passed and similar to the Crime and Disorder Act, it prohibits unfavourable treatment of others based on the grounds of protected characteristics such as race. This concept is known as direct discrimination and is outlined in section 13 of the Act. A person (A) directly discriminates against another (B) if, because of a protected characteristic, person A treats person B less favorably than person A treats or would treat others. The concept of direct discrimination outwardly appears to be somewhat already incorporated in the Crime and Disorder Act.
