3. Write a short note on food safety act 1995? List some of the risks, penalties and consequences of not complying with food safety legislation. Answer: The purpose of the Act is to ensure the purity of food sold. Local councils and the Department of Health & Human Services administer the Act. Under the Act, food business owners are legally responsible to ensure that food sold to customers is safe and suitable to eat.

5. Which are different areas covered under intellectual property? Describe one business activity that breaches copyright legislation. Answer: Intellectual property is a property that is owned by an individual or an organization which can then choose to share it freely or to control its use in certain ways. It can be an invention, a trade mark, a design or the practical application of your idea, literary and artistic creation, invention, brand name, design, logo, name, image and copyright. If you or your employees engage in any of the information-sharing activities without permission then you may be in breach of copyright legislation. For example: using the other business logo without permission in your business.

6. Write a short note on liquor law (Liquor Reform Act) Name some practices prohibited under RSA. Answer: Liquor law of Australia regulate the sale and consumption of alcoholic beverages. The Liquor Reform Act is the primary piece of legislation regulating the supply and consumption of liquor. Practices prohibited under RSA are: not to serve the customers under 18, purchasing on behalf of minor (under 18), intoxicated customers and customers affected by other drugs.

7. List five sources of information you can use to update legal knowledge? Answer: Appointing a legal advisor, joining a trade organisation, participating in trade shows and conferences, face to face networking and online sources like Blogs, Twitter, LinkedIn, Google alerts and forums etc.

Describe the process for updating systems and procedures in your workplace (to cover new laws or area of non compliance) and how could you distribute, communicate and share policies, procedures, legal information and update in an organised way so staffs know their roles and responsibilities regarding compliance. Answer: We should set deadlines for communicating compliance information or changes and inform all staff by a group discussion, events or function. Issue written notice with the payslip of all employees. We can email the compliance information and changes to all employees. Put on view compliance posters and signs or even hand out flyers and display clearly near all hazardous equipments.

9. List five general requirements of state/ territory gaming laws and regulations. Answer: Gaming law is the set of rules and regulations that apply to the gaming industry. Owner must have a proper license to provide gaming facility. Employees must have an appropriate license and training to deal with the customer. Employees must be free from any criminal background. Warning signs of risk of gambling must be displayed clearly. All gambling activities must be recorded in case of any problem. Minors are neither encouraged to gamble nor allowed to do so. All machines should be working honestly.

10. What are three consequences of non-compliance with environmental law? Answer: Any business found breaching the environment law can be fined, send to jail or recovered the cost of cleaning and maintenance.

13. The national employment standards (NES) sets out ten minimum entitlements that apply to all employees and employers in the national workplace relations systems. List some of these entitlements. Answer: The NES are set out in the Fair Work Act. Some entitlements are: Maximum weekly hours of work – 38 hours, Requests for flexible working arrangements, Parental leave and related entitlements – up to 12 months unpaid leave, Annual leave – four weeks paid leave per year, Public holidays – a paid day off on a public holiday.

18. List some ways to monitor and continually evaluate your business compliance system. Answer: Business Compliance System is structured into the following elements: regular risk assessment, development of policies and procedures, establishment of training and communication plans in the areas of compliance and ethical conduct, development and monitoring of a report and consultation management system, control monitoring, and carrying out of investigation and corrective measure implementation activities, where applicable.

19. What is a risk assessment used to measure? Answer: Risk assessment is the process where you Identify hazards and analyse or evaluate the risk associated with that hazard. It determines appropriate ways to eliminate or control the hazard.

20. Why should you continuously review and distribute plans, policies and procedures for compliance with current laws and licensing requirements? Answer: To successfully running a business we need to review our policies and procedures because a policy is a course of action or guidelines to be followed whereas a procedure is a outline of the policy, outlining what has to be done to implement the policy. Policies and procedures should be regularly reviewed in order to ensure they reflect current good practice and legal requirements.

21. You’re planning to open a new restaurant. List some regulatory authorities you might communicate with first. Answer: Local City Council to comply with local laws, Environmental Health Service, Taxation Office for various taxation laws, Fair Work Ombudsman, Liquor Licensing Authority, Water and Energy Supply Company, Consumer Affairs Department etc.
