Den lovgivende er Folketinget, og den udøvende er regeringen. 2. Hvordan kontrollerer de to magtinstanser hinanden? (brug figur 6.15)
Folketingets hovedopgave er kontrollen med regeringen, og bestemmer regeringsdannelsen, påvirker lovforslag, debatter, forespørgsler og spørgsmål. Regeringens kontrolmidler er initiativmonopol, administrativ magt, opløsningsret og retten til at gå af. 3. Beskriv lovgivningsprocessen i Danmark (brug figur 6.14) 1. Initiativfasen: behov for ny lovgivning formuleres af organisationer og ministerier. 2. Lovforberedelsesfasen: lovforslag forberedes evt. I en kommission/lovforberedende udvalg. 3. Beslutningsfasen: 1. Behandling – stående behandling. 2. Behandling – ændringsforslag, evt. udvalgsbehandling. Her stemmes også. 3. behandling - vedtagelse. 4. Implementeringsfasen: ministerier og andre myndigheder gennemfører loven. 4. Hvilke andre aktører end den lovgivende magt spiller en rolle i processen?
Interesseorganisationer indgår, udover regeringen, folketinget og ministerier, i det formelle lovgivende magt. Derudover har medierne også en ret stor rolle, idet de udgiver hvad de selv vælger. 5. Hvad er positiv parlamentarisme?
I lande med positiv parlamentarisme skal de partier, der danner regering, fra starten have et flertal i parlamentet bag sig, mens de regeringsdannende partier i lande med negativ parlamentarisme kan nøjes med ikke at have et flertal i parlamentet imod sig. 6. ...groups: the economic elite and political elite. The economic elite are defined as big businesses that want a big, single market of which to trade in of which the political elite push forward. The political elite constitute: heads of governments, foreign ministers, civil servants and the Commission who have come under a lot of scrutiny by euro-sceptics for being undemocratic. Elite domination can be evidenced by the Maastricht Treaty of 1992 and Denmark as a member state. The Maastricht Treaty was the most important treaty in terms of change of rules of the EU and Demark wanted to consult with its population before accepting the terms by holding a referendum. The first referendum led to a rejection by the Danish people however a second referendum was held on the issue in which the Danish population agreed to accept the treaty. This is a clear example of the EU not taking no for an answer and shows how the EU is led by an elite that will not take rejection from the population of an EU member-state. This can be evidenced further by idea of an EU Constitution that the elite were in favour of because it would create in theory a “United States of Europe”. The French and Dutch held referendums on whether to accept an EU constitution and both rejected the proposed Constitution.
