...Leading Ideas: Revisiting the Abilene Paradox: Is Management of Agreement Still an Issue? | |by Kathryn J. Deiss, ARL Office of Leadership and Management Services Program Manager In 1974, Professor Jerry Harvey of George Washington University developed a parable from a real-life experience to describe the issues surrounding how individuals reach agreement, or, more specifically, believe they have reached agreement. Twenty-five years later the lessons and insights his parable generates are still valid and provocative for organizations and the individuals who work together in those organizations. The Parable of the Abilene Paradox1 Four adults are sitting on a porch in 104-degree heat in the small town of Coleman, Texas, some 53 miles from Abilene. A large part of that power and weakness comes from the congress and its representatives. Representation within the government became an issue because everyone wanted equal voice. The Three-fifth compromise was an agreement between these diverse opinions to create a proper system of representation. It was a temporary fix to the issue for a much larger problem. The Three-Fifths Compromise is the third clause in Article one, Section two. Article one is aimed towards Legislative branch and specifies the job and limits of the branch. Section...

...Lewicki−Barry−Saunders: Negotiation: Readings, Exercises, and Cases, Fifth Edition Cases 1. Capital Mortgage Insurance Corporation (A) © The McGraw−Hill Companies, 2007 Case 1 Capital Mortgage Insurance Corporation (A) Frank Randall hung up the telephone, leaned across his desk, and fixed a cold stare at Jim Dolan. OK, Jim. They’ve agreed to a meeting. We’ve got three days to resolve this thing. The question is, what approach should we take? How do we get them to accept our offer? Randall, president of Capital Mortgage Insurance Corporation (CMI), had called Dolan, his senior vice president and treasurer, into his office to help him plan their strategy for completing the acquisition of Corporate Transfer Services (CTS). The two men had begun informal discussions with the principal stockholders of the small employee relocation services company some four months earlier. Now, in late May 1979, they were developing the terms of a formal purchase offer and plotting their strategy for the final negotiations. The acquisition, if consummated, would be the first in CMI’s history. Furthermore, it represented a significant departure from the company’s present business. Randall and Dolan knew that the acquisition could have major implications, both for themselves and for the company they had revitalized over the past several years. Jim Dolan ignored Frank Randall’s intense look and gazed out the eighth-floor window overlooking Philadelphia’s Independence...

...Arbitration Act requires that where the parties have agreed to arbitrate, they must do so in lieu of going to court. Once an award is entered by an arbitrator or arbitration panel, must be confirmed in a court of law. Once confirmed the award is then reduced to enforceable judgment, which can be enforced by the winning party in a court of law, like other judgments. The federal Arbitration Act awards have to be conformed within the year. If the losing party wants to object they only have three months to do so. Arbitration agreements can be entered “prospectively” that is in advance of any actual dispute. They may be entered into by disputing parties once one has a risen. Section two of the Federal Arbitration Act states that arbitration provisions will be subject to invalidation only for the same games applicable to contractual provision generally, such as unconscionability or duress. Consequently most state law that disfavors the enforcement of the agreements will be preempted by the FFA. Not all state laws regarding arbitration are preempted. (2014) The Federal Law on International Commercial Arbitration, 1993 (the law) governs international commercial throughout the entire territory of Russia. Businesses pay federal income tax just like individuals. In a sole proprietorship, the owner pays income tax only once on the business income, which he or she reports on their personal income form. The third characteristic is control. In a sole proprietorship, the owner makes all the decisions concerning the business. In this business, the owner does not have to grant control to other people. However being an upscale store, it is constantly under the threat of economic slowdowns, product substitutions and of course competition! Therefore a market expansion strategy across international shores would present an ideal opportunity to Saks Fifth Avenue to build on its brand equity and continue its conquest for growth. These market entry strategies will depend on a number of factors – Expansion into emerging economies Vs Developed nations, Logistical issues, Price sensitivity, Culture of economies and many more. Furthermore, it may be advisable to pursue a combination of market entry techniques at different stages in the international expansion plan to ensure that a consistent brand message is being delivered. Some market entry strategies suggested are as follows – * Direct Exporting - This may be an initial test to understand the customer’s perception of Saks and how they value it. The advantages of this technique include relatively easy entry, low risk and low advertising investments. Disadvantages include low market coverage. * Licensing – Saks Fifth Avenue owns several private label brands including a line of menswear called The Men's Collection. Young sara.b.young@anglistik.uni-giessen.de www.uni-giessen.de/~ga1047 Subject and Verb Agreement: The Basics A subject must agree with its verb in number. Ann always tells the truth. The twins always tell the truth. A phrase or clause that comes between a subject and the verb does not affect subject-verb agreement. The captain of the guards stands at attention. The troopers whom the captain put in charge of the roadblock stand on either side. Compound subjects consist of two or more subjects usually connected by or or and. Specific rules apply to compound subjects. Two or more singular subjects joined by or or nor must have a singular verb. o Beth or Sally is going to represent us. Two or more plural subjects joined by or or nor must have a plural verb. o The class presidents or the student council members are going to represent us. ...Management of Agreement Joseph NGENZI MPAM/3020/11 This Term Paper is Submitted in partial fulfillment of UNIT MBA 603 grades of the School of Business and Public Management for the award of Master of Public Administration and Management. Mt. Kenya University July, 2011 INTRODUCTION Four adults are sitting on a porch in 104-degree heat in the small town of Coleman, Texas, some 53 miles from Abilene. They are engaging in as little motion as possible, drinking lemonade, watching the fan spin lazily, and occasionally playing the odd game of dominoes. The characters are a married couple and the wife’s parents. At some point, the wife’s father suggests they drive to Abilene to eat at a cafeteria there. The son in-law thinks this is a crazy idea but doesn’t see any need to upset the apple cart, so he goes along with it, as do the two women. They get in their unaired-conditioned Buick and drive through a dust storm to Abilene. They eat a mediocre lunch at the cafeteria and return to Coleman exhausted, hot, and generally unhappy with the experience. It is not until they return home that it is revealed that none of them really wanted to go to Abilene–they were just going along because they thought the others were eager to go. Naturally, everyone sees this miss in communication as someone else’s problem. Dr. Harvey used this wonderfully simple parable to illustrate what he believes is a major symptom of organizational dysfunction: the management of agreement as opposed...
