Why Are Initiatives Necessary

The issue of whether initiatives are necessary with our electoral system is one which has been questioned over time. It is an issue of Direct Democracy. Should states allow citizens to make laws directly through ballot initiatives? Some say that it is every citizen of this country’s right to take part in legislation when it involves matters that directly affect them. Others says it should be left up to the lawmakers and politicians who are elected by the people to make these sort of decisions on their behalf. If there is an electoral system in place in which citizens vote in candidates who they believe will make the right decisions and know what is best for the people then why are there initiatives? This paper will examine both sides of the issue and make a determination as to the practicality of initiatives in our current electoral system.
Those who believe that initiatives are necessary site many reasons. There are those who say that initiatives change citizens’ policy preferences and that they also lead to defective laws. It is a matter of whether the …show more content…
As Chemerinsky explains, “there are three main ways in which our Constitution tries to balance majority rule with minority rights. One way is that we have laws adopted by representatives, and not directly by the people. Second, we have a structure of government that includes separation of powers, and checks and balances, which serves to protect the rights of the minority. Third, we put our enduring values, our most cherished commitments, in a Constitution that is very difficult to change (295). Essentially, he is stating that the Framers of the Constitution constructed it in such a way so that it would be extremely difficult to alter.
