He was sentenced to a bad conduct discharge, confinement at hard labor for one year, forfeiture of all pay, and a grade reduction. This case and conviction went before the United States Army of Military Review December 23, 1970. During the trial evidence produced involved the Lieutenant addressing the Appellant and provoking him by using the derogatory term “boy.” The Court held that the misconduct regarding the Lieutenants communication with the Appellant divested the Lieutenant of his authority as a superior in regards to the offenses committed by the subordinate as shown in United States v. Revels, 41 CMR 475 (1969). In regards to the Revels case, the court dismissed the disrespect charge and part of the assault charge in regards to “assault upon a superior officer”, while affirming the assault charges. The Judge found that the Lieutenant’s conduct fell below the standards of a soldier, and divested himself therefore he did not have the special protection offered to superior officers by Congress.
