IV. Religion Discrimination
Religion is a subject of discussion in recent years because different religions are being introduced to the world. Many people are raised in a particular faith from when they were little but more than a quarter of them have since left their faith. About 44% of those people have switched faiths. People who are unaffiliated with any faith make up about 16% of people today. One in four Americans, ages 18-29, say they are not affiliated with any particular religion. 51% of Americans say they are members of the Protestant denominations. One in three Americans were raised Catholic and only one in four describe themselves at Catholics today. In today’s America, there are 1.7% of Mormons, .7% of Jehovah’s Witnesses, .3% of other Christian groups, 1.7% of Jews, .7% of Buddhist, and .6% of Muslims. Women are more likely to claim a religious belief and 37% of married people are married to someone from a different religion (The U.S. Religion, 2008).
1. Civil Rights Act explanation
The Civil Rights Act of 1964 covers any federal, state, and local employer with 15 or more employees from discriminating based on race, color, sex, religion, or national origin. They may not use any of those bases to determine if an employee is eligible to be hired, fired, promoted, compensated, terms of the job, or privileges. Reasonable accommodations for religious practices cannot cause undue hardship on the conduct of the employer’s business. The employer can offer a reasonable accommodation that does not have to be the employee’s specific request and only after a good faith effort can the employer claim that no accommodation could be made without undue hardship. Undue hardship can be defined as costs that are more than minimal cost. Certain accommodations include working on Christian holidays such as Christmas in order to be off for Jewish holidays, or working
