NEW YORK (WENY ) - On behalf of one local Steuben County family and hundreds across New York State, local lawmakers were in Albany Wednesday to push a new law. The legislation calls to extend the time period murderers and violent offenders can apply for parole. For the Robie family, that extension means less heartache.

For families like the Robie's they're forced to relive their worst nightmare every 18 months. In 1993, their four-year-old son Derrick, was brutally murdered in a wooded area just outside their Savona home. Derrick's killer, 13-year-old Eric Smith was sentenced to 9 years to life in prison. Which means Dale and Dori and other members of the Robie family are forced to relive their son's death at least every two years and fear his killer could walk the streets.

The Robie's explain, about every 18 months they have to get letters ready for the parole board, get petitions signed and revisit the events on their son's murder. "It's very hard because I have to deal with backlash from people. A lot of people blame me for what happened. So I have to deal with that every couple years," explains Derrick's mother, Dori Robie. …show more content…
The legislation would extend the amount of time violent offenders, like Eric Smith, are eligible for parole from two years to five years. The law would allow the state parole board to decide on a case by case basis whether someone is eligible for parole before the five years. However, compared to the current law it would only be mandatory for a criminal to go before the parole board every five years. "Certainly this legislation isn't going to fill the hole in their heart for the loss of their loved one. But certainly can make it a little bit easier when the have to go through this ordeal every 18 months," explains Assembylman Phil
