When answering the question has the requirements of due process been met I think for most people the answer would be a resounding yes, however, let’s play devil’s advocate here and disagree. Procedural due process basically covers several aspects of life such as the fact that all citizens will be afforded life, liberty, and the pursuit of happiness. This also governs how an individual should be treated prior to and during the hearing process in court. Mind you sections 401 through 406 cover several examples such as the fact that a person who is suspected of a crime should be given a fair amount of time to prepare evidence defending said crime they are accused of committing. 402 governs how testimonies should be given, and ensures that individuals …show more content…
While on the subject there is a satire docu-drama on Netflix entitled American vandal where a student was suspended without there being evidence showing he committed the crime. Imagine this is your child or you, how is that fair? Another example of due process of due process not being met is the fact that the accused is technically allotted time to prove his or her innocence however, what exactly are resources like for individuals in jail? What if you have no motive and unfortunately no alibi? Now imagine you couldn’t afford a lawyer so you receive a court appointed one. I am not trying to bash court appointed lawyers however, there is a reason individuals shell out copious amounts of cash for certain lawyers they are worth it. And unfortunately, repeatedly not only has gender, race and economic status played a part in how a defendant is treated but their quality of care is ultimately affected as well. Another instance that I can’t help but think about here is a young man who couldn’t afford to pay his bail and he was waiting in in jail for years and repeatedly but in solitary confinement which resulted in him killing
