...Ashley Mayes Criminal Law Essay 3 23 February 2014 Ashley Mayes Criminal Law Essay 3 23 February 2014 Crimes against Property: Larceny Crimes against Property: Larceny Crime against property means a crime that destroys or deprives an owner of property against the owner's will. These crimes are considered less serious than violent crimes, or crimes against persons. Crimes against property are not as obvious as they sound. Although they deal with damage or theft of physical property, sometimes they also involve harm or threat to individuals. When people are involved, the penalties for crimes against property can increase a great deal. The crime I am going to specifically talk about is larceny. I will discuss the physical properties of it, the statutes in the state of Ohio, and the common law definition of larceny. Larceny is a crime against property, and is a form of theft. It is the” unlawful taking, and carrying away of another’s tangible personal property with intent to deprive the rightful owner of the same. “It is also considered a crime against possession. The taking element requires that the offender take actual physical control of the property without the consent of the owner. If the offender merely deprives the victim of possession, it is not larceny. The offender must have gained control over the property and that control must be complete. The offender must have taken the property with the intent to steal it. And the intention required is one intended...

...the crime. The people who enforce these punishments make up the criminal justice system. Three of the main parts of the criminal justice system are law enforcement, the courts and prisons. Law enforcement includes jobs such as sheriffs and patrol officers. The court system offers careers in law. Correctional facilities and prisons include jobs such as counseling and correctional officers. There are many jobs involved in law enforcement. The sheriff, the highest-ranking officer in law enforcement, oversees the entire department. The sheriff is an elected office that is voted on by the citizens of the county. Once elected a sheriff holds a four year term. After the four-year term a sheriff can be reelected an unlimited amount of times. The sheriff has several duties both in his office and outdoors. These duties include uniformed patrol, crime prevention, and criminal investigations. The sheriff also has some of the duties of a patrol officer such as apprehending violators of the law and assisting in prosecutions. Two basic requirements of a sheriff are that you must be a United States citizen and you must not have any prior felony convictions. In Washington State the average salary for a sheriff is about $4005 per month. A law enforcement or patrol officer maintains law and order in a certain area. People who are interested in becoming a...

...and is not insane. In the state of Michigan Stu Dents would be getting the charge of first degree murder since he had committed murder but also the charge of kidnapping and robbery as well. In this case Stu Dents is not mentally incapable and is more than willing to stand trial for the actions that he committed that night. Although he was talking about aliens when he hit the officer does not mean that he is mentally incapable as he was probably just trying to save himself from being charged with a long sentence. It is very clear that Mr. Dents had committed the murder especially since many of her items were found at his home along with many different drugs. Even though there was no sign of forced entry there is still enough evidence to place him at the scene of the crime with the diary with him talking about things to buy and also having her belongings in his possession at his house as well. Here in Florida Mr. Dents would have been charged with First degree murder- due to the act being premeditated- the prosecution will have to show Mr. Dent’s specific intent to kill by stabbing the victim 13 times. The journal that Mr. Dent had in his home along with the photos of the victim will show, how he stalked her as well. This charge is a capital offense in Florida and the State may choose to seek the death penalty. For punching the officer Mr. Dent would be charged with Battery on a law enforcement...

...usually incorrectly. Some people say animals or even trees get murdered, but under the law it is not murder unless a human takes the life of another human. Homicide is a lawful term for any killing of a human being by another human being. Homicide itself is not automatically a crime, some homicides are legal, such as the justifiable killing of a suspect by the police or a killing in self-defense. Unlawful homicides are classified as crimes like murder and manslaughter. This paper will explain the important but often overlooked distinctions between murder and manslaughter, and the different variations of both crimes. When we look at “murder” we must also look at the different degrees of murder which are a reflection of the intent or severity of a certain murder charge. The most common degrees of murder are 1st degree murder and 2nd degree murder and in some cases what we call “capital murder”. Regardless of the label on the degree of the murder committed, the general idea is to increase the punishment with the degree. The more inhumane the killing is, or the motive associated behind the killing, then the greater the punishment and degree is for the murder. We must first understand what murder is: Murder is the killing of one human by another that is intentional, unlawful, and done with “malice aforethought” or in other words, premeditated. Malice aforethought is a key element in determining the degree of the murder committed. This state of mind during the act can provide evidence that...

... Laws concerning public safety and the privacy of individuals contradict one another. A question arises from the situation in regard to whether public safety or individual privacy receives a higher priority based on situations that are individualistic. Although the Fourth Amendment provides protection for the citizens of the United States, there is room for occurrences of crime although the amendment reduces law enforcement’s efforts at crime reduction methods and access to evidence. During the last decade, the Supreme Court made rulings in regard to public safety, privacy, and sex offenders. This paper will debate and analyze two Supreme Court cases; People v. Cintron, and Connecticut Department of Public Safety v. Doe. This paper will also summarize the Supreme Court decisions along with the implications these cases have in regard to social police in the area of public safety. Changes to the approaches taken by law enforcement personnel in regard to individual rights and public safety have taken place because of rulings by the United States Supreme Court. Agencies have additional authority over the protection and application of civil rights, which in some instances bring into question if there is a violation of an individual’s Fourth Amendment rights. In the past, the shattering of privacy rights and changes made by recent Supreme Court rulings and law makers intrigue privacy rights and civil activists. The...
