...Service proposed this regulation. This agency helps to define eating standards for children throughout the U.S. school system. I’m concerned that a lot of children are obese and not eating properly. This produces health problems when they get older and help to increase health care costs. This will affect me by helping my premiums increase for health care costs. 2. The proposed change will help to improve the health of children in school by providing nutritious foods for them to consume throughout the course of a school day. 3. My comment is there has been a big increase in childhood obesity over the past decade. I see this proposed regulation as a positive step towards promoting healthier eating habits for children. Parents should follow in the footsteps of the school system in promoting a healthy diet for their children. This is only part of the solution towards decreasing childhood obesity. This will be an epidemic problem unless we all join forces to come to a solution. 4. The deadline for the public comment was April 9, 2013. 5. A. You will have three choices to choose from after the public comment period. You can adopt the rules. Second, modify the proposed rules and do the public comment again. Third, you can withdraw the rule. B. The first theory is arbitrary and capricious. This theory is applied to informal rulemaking and simply requires the agency to support the proposed rule. The second theory is the regulation is unsupported by substantial...

...12 of the Most Confusing Basketball Rules When taking a charge, does the defensive player have to be still? Basketball rules state that if a defensive player is in a legal defensive stance or position, the defensive player has the right to move in order to maintain his legal positioning. A charging call can be made even if the defensive player has one or both feet off of the ground when the offensive player makes contact with the defensive player. The basketball rule of “verticality” applies here. If a defensive player jumps straight up to block a shot and the offensive player jumps into and creates contact with the defender, an offensive charging call could be made. (Therefore, it is more important if a defender is squared up and contact is made to the defender’s chest than if the defender is moving.) Is a dribble illegal if it goes over the ball handler’s head? Basketball rules states if the ball handler doesn’t “palm” the ball or place their hand under the ball, there is no dribbling violation. There is no basketball rule or restriction on how high a dribble can go. Is reaching into an offensive player's area a foul? If a defensive player “reaches in” to attempt a steal or distract the offensive player they are guarding and doesn’t create any contact, no foul should be called. Reaching in isn’t necessarily a foul until contact is created. Basketball rules state that the foul isn’t called reaching in, but holding or pushing. Is over the back a foul when rebounding...

...Administrative agency: Regulations Monika Felton Keller Graduate School of Management Legal, Political, and Ethical Dimensions of Business MGMT 520 Professor Melchiori November 5, 2012 Administrative Agency: Regulations The Administrative Agency The Federal administrative agency for which the chosen regulation controls is the United States Department of Agriculture, (USDA). The agency under the USDA for which the departmental proposed regulation falls is the Food and Nutrition Service, (FNS); the FNS works to reduce hunger among low-income populations providing greater access to higher nutritional standards with the aid of the U.S. agriculture (www.USDA.gov). The proposal addresses the administrative aspect of local educational agencies, (LEA), on the school lunch program and how best to ensure accurate documentation and assessment of family eligibility. The proposal affects section 304 of the Healthy, Hunger-Free Kids Act (Pub. L. 111-296) (www.USDA.gov). Why the Agency and Regulation is of Interest The proposed regulation is of interest due to the fact that it will directly affect the lives of thousands of low income children for which my job concerns. As a child case manager, approval of “free” lunches for low income households is often that bridge provides a large portion of daily and weekly meals for many clients. The regulation states that incomplete applications will not be approved; let it be noted that many parents lack the necessary data required...

...1. The administrative agency that controls the regulation is the Federal government (Department of Education). I strongly believe that education has a huge positive impact on the society. It is a must if a nation desires to attain growth and development and more importantly, maintain it. The Department of Education recognizes and keeps the importance of economic education which is why the agency and their proposed regulation interest me. The agency helps promote student achievement by all means and helps provide equal access to education for all. The proposed regulation would affect me both positively and negatively because it is a regulation that might help reduce my student debt loan at the end of my school days but at the same time, it would cut funding to thousands of job training program I might need to increase my employability and future earnings down the line. 2. The proposed regulation is meant to define the “gainful employment” requirement for federal student aid. The Department of Education is concerned that students enrolling in some school programs especially in for profit schools (e.g. Devry University), usually find themselves unemployable in those anticipated career fields and burdened with large student loan debts at the end, with no job to pay for it. With that in mind, the department of education proposed the regulation to make sure that students who are enrolled in any gainful employment programs must be guaranteed that those programs provide value,...

...Dorothy Scroggins GM520 - Week 2 Assignment Administrative Law Assignment SEP10 1. State the administrative agency which controls the regulation. Explain why this agency and your proposed regulation interests you (briefly). Will this proposed regulation affect you or the business in which you are working? If so, how? I chose the Department of Public Safety, Division 45: Missouri Gaming Commission, Chapter 5: Conduct of Gaming. One of the many benefits Casinos love to share is that money from their profits will go to a public school fund. 2. Describe the proposal/change. The Gaming Commission is proposing an amendment to 11 CSR 45-5.051, Minimum Standards for Blackjack. The amendment will allow a floor supervisor (Pit-Boss) may direct the dealer to shuffle the cards after any round of play is completed and all wagers have been resolved. It won’t affect me directly but depending on how the Pit-Boss uses this internal control method, it could help or harm the Fund that is generated for Public Schools. Shuffling the cards in the middle is a deck is used to stop the current momentum. If the player(s) at the table are hot then this can break a streak that is cutting into the Casino’s profits. In this case it’s a win for the Public School Fund. 3. Write the public comment which you would submit to this proposal. If the proposed regulation deadline has already passed, write the comment you would have submitted. Explain briefly what you wish to accomplish with your comment...

...A school littered with anarchy. A school drowned out with neither rules nor authority. Chaos is it not? Of course this is what would occur if school regulations were revoked. In my opinion school rules do not violate the freedom of students. Not only do they protect our students but they also secure their education on a whole. Does outbursts of chaos, the grievances of violence and the dangers of bullying seem child friendly? If your answer is no, then we can both agree that school guidelines should stay intact. An absence of rules would issue an unstoppable outburst of anarchy. Without school regulations, students may descend into utter chaos. For example, with a lack of rules the probability of students attending classes is very slim. Some irresponsible students may not even participate in lesson or even attend class, thus defeating the purpose of attending school. Why you asked, because there isn’t any rules relating to attending classes. Secondly as school guidelines become invalid, students would not only pose a threat to their education but also themselves. An absence of direction such as no weapons or drugs are promoted, students may be in danger as some may fall to the corruption of drug abuse. Also the rate of gang fights between students may reach and alarming rate. Soon enough teachers may not even want to enter the school. We don’t want another Virginia Tech Massacre do we? Finally the lack of rules can and most likely will encourage bullying, which as of late is...

...The gap in the rules and regulations of high school and college basketball is doing aspiring athletes a disservice. These athletes deserve standard regulations throughout their years of play. The three major differences are: game length, three point line, and the existence of the shot clock in college. In a high school basketball game there is four eight minute quarters adding to a thirty-two minute game. Each team receives five timeouts, three sixty second timeouts and two thirty-second timeouts. In a college game there is two twenty minute halves for a total of forty minutes. Each team has four seventy-five second timeouts and two thirty second timeouts. In college, there are also media timeouts which give coaches extra time to coach their teams without using one of their own timeouts. There is no such thing as a media timeout in high school basketball. The gap in the game length of high school and college is not adequately preparing prep players for the next level of play. The players are not used to such long of games when they reach the college level, therefore they are not in the best shape they could be. A high school season last about twenty-five games while a college season lasts about forty games. This aspect also is doing players a disservice because it is not preparing them adequately...

...A Great Public School: A Basic Right and Our Responsibility A school functions as a body. All parts are important and needed to function at a certain level. A great public school comes with rights and responsibilities. It needs it need parent and teachers support as well as the community working together, rules and regulation, and also high expectation from students. As students we have our rights such as the right to be protected from bullying, to learn without interruptions, and the right to sick leave and health care. Where there are right, there is a responsibility, some of which includes attending class regularly and onetime, respecting teachers, getting good grades, and following the school rules. Teacher’s responsibilities are making sure that they have their classrooms under control and that is being displayed among one another. Reason being is because when there is no control/respect how can one learn/teach. It’s the teacher’s responsibility to make sure that they have the adequate training, supplies and effective resources to teach their classes. Because what teachers have to remember is times are changes, each student learn differently, and it is a teachers job to make sure that each student is not being left out when the courses are being thought. All schools must have rules and regulation that is necessary for student teachers and staff. It is important because they are generally set in place for the safety of the people involved. It also builds a foundation...

(10 points) The legislation I chose to research is the “Protecting Academic Freedom in Higher Education Act” (H.R. 2117). This bill seeks to repeal a recent rule change by the U.S. Department of Education, which federally defines a credit hour as used by all institutes of Higher Education. It would also repeal the so-called state authorization regulation which significantly expands and complicates existing federal requirements for an institution to legally operate within a state I chose this legislation because as a leader in Higher Education the statute directly impacts my and all schools in the country; unduly burdening us and limiting the rights of our students. 2.
