Civil Conspiracy

Finally, the Plaintiff claimed the Defendants conspired against him to deny him due process. Civil conspiracy require the following: “two or more persons, an object to be accomplished, a meeting of the minds in the object or course of action, one or more unlawful overt acts, and damages as the proximate result thereof.” (Stoldt v. City of Toronto, 1984). Because the court determined there was no due process violation, there was no object to be accomplished. Additionally, there was an overall lack of evidence to prove civil conspiracy. This, the court granted summary judgment on this claim.

Implications

The case demonstrates that a college has the ability to dismiss a student based on their own unique admission standards.
