A person may be liable under a theory of defamation for the publication of defamatory statements of and or concerning the plaintiff. Libel is written defamation. When the defamation involves a public figure and matter of public concern, in order to prevail, the plaintiff must show that the statements were false and that the defendant acted with malice. Libel plaintiffs must establish defamation, publication, identification, and fault in order to prevail (Siegel, 2014, p. 86). Being a corporation that served rat meat would be highly objectionable by a reasonable person and if people were to believe this story, it would certainly cause damage to Billy’s Burgers reputation as it already has. Her 70,000 followers started a viral campaign against Billy's Burgers, causing the corporations sales to drop $25,000 per month within a three month timeframe. Due to this success, previous to these allegations Billy’s Burgers earned approximately $100,000 per month in hamburger sales. Billy’s Burgers is a prominent company with a highly respected and sought after product, thus it can be presumed that this restaurant is a public figure. In addition, the claim that Billy’s Burgers serves “rat meat in [their] burgers” would be a matter of public concern.
