...District of Indiana. The defendants, Patrick Gibbs and O’Malley’s Tavern are pursuing a summary judgment. Summary judgment is the resolution of a case without trial if the judge deems that there are no disputes to the material facts of the case. The Defendants in this case claim there is no evidence to support that bartender John Daniels saw any visual signs of intoxication from Edward Hart and only contextual knowledge can be proven. If the defendants can prove there were in fact no visible signs of intoxication then they will not be subjected to any legal wrong doing based off the 1988 Indiana Supreme Court Case which stated that contextual knowledge alone will not suffice. The plaintiff, Deborah White, is requesting that the court denies the defendant’s request for summary judgment. The plaintiff claims to have sufficient evidence which will prove bartender John Daniels did see visible signs of intoxication from Edward Hart. Edward Hart had consumed 11 drinks within a two hour span while at the Tavern. Regardless of body type, shape or size that amount of Alcohol consumed by a single individual can reasonably infer that he had shown visible signs of intoxication. Edward Hart had been observed falling off of his stool as well as tripping over a pool stick by another patron in the bar. Upon leaving the bar Edward Hart had hit multiple parked cars in the parking lot. Mr. Hart displayed signs of his inability to operate a motor vehicle by swerving all over the road, driving on the...

...warrant, to make a felony arrest if they have probable cause and or exigent circumstances. In this case, if the circumstances of the accident scene had given Deputy Olmanson probable cause to arrest respondent for the offenses he was later charged with, those offenses were charged as misdemeanors (STATE V. OTHOUDT). As of this writing, neither the Minnesota Supreme Court nor the United States Supreme Court has ever held that exigent circumstances would permit a warrantless entry into a home to arrest for an offense of this level (State of Minnesota, Respondent, vs. James Howard Klein, 2014). Cases such as this one could possibly jeopardize the privacy protections offered by the Fourth Amendment and create the potential for abusive police practices (Cars, Cops, and Crooks: A Reexamination of Belton and Carroll ). An attempt to expound upon the effects of failing to obtain consent to make a warrantless search of a dwelling is explored. Case Brief: State v. Othoudt, 482 N.W.2d 218 (Minn. 1992) * STATEMENT OF THE CASE: This case is an appeal by the State of Minnesota of the trial courts findings of the state’s warrantless search and entry of the Othoudt home, which culminated in the arrest and charges against Richard Othoudt, was in violation of the fourth amendment of the United States Constitution and article 1 of the Minnesota Constitution. * STATEMENT OF THE FACTS: On Jan. 30, 1990, Sherburne County, Minnesota Deputy Sheriff Olmanson was dispatched to investigate a traffic...

Kahatsu defined evidence –based public health as “the process of integrating science- based intervention with community preferences to improve the health of population” Coriel 2010 p.5 Evidence-based practice involves best available research evidence (qualitative and quantitative) from sources like scientific literature in systematic reviews and journal articles, public health surveillance data, program evaluation, community members and media. Evidence –based practice involves participation of the community. Their needs, values, preferences and assets are taken into consideration. Also, it involves resources and expertise. All these are put together in making informed decision. Evidence-based practice is positive outcome focused. It involves using tools, intervention...

...The scientific literature on the dangers of driving while sending a text message from a mobile phone, or driving while texting, is limited but growing. A simulation study at the Monash University Accident Research Center provided strong evidence that retrieving and, in particular, sending text messages has a detrimental effect on a number of safety-critical driving measures.[6] Specifically, negative effects were seen in detecting and responding correctly to road signs, detecting hazards, time spent with eyes off the road, and (only for sending text messages) lateral position. Mean speed, speed variability, lateral position when receiving text messages, and following distance showed no difference.[7] A separate, yet unreleased simulation study at the University of Utah found a sixfold increase in distraction-related accidents when texting.[8] The low number of scientific studies may be indicative of a general assumption that if talking on a mobile phone increases risk, then texting also increases risk, and probably more so. 89% of U.S. adults think that text messaging while driving is "distracting, dangerous and should be outlawed."[9] The AAA Foundation for Traffic Safety has released polling data that show that 87% of people consider texting and e-mailing while driving a "very serious" safety threat, almost equivalent to the 90% of those polled who consider drunk driving a threat. Despite the acknowledgement of the dangers of texting behind the wheel, about half of drivers...

...Mrs. White and the O’Malley Tavern I would say that of course Mr. Hard is at fault for drinking and driving, but I also feel that O’Malley’s Tavern is also at fault for over serving a customer to the point of excessive intoxication. The facts of the case were very clear cut and obvious to me. The bartender at O’Malley’s Tavern served Mr. Hard six beverages within the last half hour he was at the bar. On the tab Mr. Hard paid it showed that he ordered 13 drinks and that 11 of them were consumed by Mr. Hard. His blood alcohol content was at a .20, which is two times the legal limit of .08. Being in the medical field and also being a Command Drug and Alcohol Program Advisor for the Navy I know that at a .20 there is no way you are of sound mind to do anything. Usually a person with this Blood alcohol content are confused, they need help completing tasks (standing, walking, using the bathroom), they are between 50-100 times more likely to get into an accident, and they are very close to being incoherent. At 7:43pm Mr. Hard left the bar, according to the bartender, appearing to be of sound mind and judgment. He was picked up by the police at 7:55pm slurring, disheveled and with no recollection of what had happened. Clearly this man had way too much to drink and should have never been served this much in such a short period of time. According to the Dram Shop Act Indiana Code 7.1-5-10-15.5 “Sec. 15. (a) It is unlawful for a person to sell, barter, deliver, or give away...

...profession will continue to evolve pass the year 2025. Since the inception of a college education for introductory nursing, advanced degrees are now required for specialized practice and there is a push for more doctoral educated nurses. Moreover, hospitals in their effort to acquire magnet status are requiring their nurses to possess a minimum of a Bachelor’s degree to be employed. This trend is mentioned in the article –Visioning the Future of Nursing: Analysis of the IOM/RWJ Foundation Report which made recommendations for an 80 percent increase in nurses with a baccalaureate degree by 2020 ("Visioning the future of nursing," 2011). Master’s and doctoral educated nurses have specialized knowledge and skills to make not only a significant impact on the profession of nursing, but also on the discipline and science of nursing. Nurses continue to engage in research and incorporate theory into their models so that new insights can be gained from ideas which leads to improved practice and patient outcomes. In the future, I hope nursing research will gain more funding. Funding for nursing research will expand on scientific foundation of nursing used in clinical practice, help to prevent and eradicate diseases, control and stop the effects of illnesses, and enhance quality of life. Nurses today strive to practice to...

...References……………………………………………………………………15 Introduction The retail industry is pretty stabilized in today’s economy. The ability to have a competitive advantage is the key to survival. The grocery business has a history low job satisfaction and high performance which are costly to the organizations bottom line. This paper will document the issues that are affecting the organizational culture at the Ultra Foods in Forest Park, IL. Ultra Foods is the organization that will be closely analyzed for this course project. It is a privately owned, regional, super warehouse food retailer whose company headquarters is located in Highland, Indiana. It competes in the Supermarkets and Other Grocery (except Convenience) Stores under the NAICS number 445110(IBIS). The chain of stores is subsidiaries of the parent company Central Grocers. The chain has been undergoing constant growth and expanding in the states of Illinois and Indiana. The grocery chain reached a milestone in 2011 when they reached $1 billion dollars in sales. I recently worked at one of our many store locations as a Front End Manager. My main responsibilities included customer service management, scheduling for a staff of 45 cashiers, monitoring and controlling the cleanliness of the front end, and occasional overall store control as the Manager-on-duty (MOD). Scheduling was a value added activity used to allocate the appropriate labor hours to...

...Running head: Mnemonics My Mnemonics Parrish Flanders Atlantic Cape Community College A mnemonic, or mnemonic device, is any learning technique that aids information preservation. Mnemonics aim to translate information into a form that the brain can retain better than its original form. Even the practice of just learning this conversion might already aid in the transfer of information to long-term memory. Commonly encountered mnemonics are often used for lists and in aural form, such as short poems, acronyms, or extraordinary phrases, but mnemonics can also be used for other types of information and in optical or kinesthetic forms. Their use is based on the surveillance that the human mind more easily remembers spatial, personal, surprising, physical, sexual, humorous, or otherwise "significant" information, rather than more abstract or impersonal forms of information (Wang). Mnemonic systems are special techniques or strategies intentionally used to improve memory. They help service information already stored in long-term memory to make memorization an easier task. There are 9 types of mnemonics music, name, expression/word, model, rhyme, note organization, image, connection, and spelling mnemonics (Congos). I didn’t need two weeks or a log to record my strategies because I have 3 that I hold dearly to my heart and that I use almost every day without even knowing until I studied this class which are music, image, and connection.
