Metodolo{ki upatstva za popolnuvawe na izjava za usoglasenosta na predlogot na propisot so zakonodavstvoto na Evropskata unija

1. Organ na dr`avnata uprava – nositel na izrabotkata na predlogot na propisot i odgovorno lice

Se vnesuva nazivot na organot na dr`avna uprava – izgotvuva~ot na izrabotkata na predlogot na propisot odnosno negovite vnatre{ni organizacioni edinici vo koi predlogot na propisot e izraboten.

2. Naziv na predlogot na propisot

Se vnesuva polniot naziv na predlogot na propisot na makedonski i angliski jazik, bez ogled dali e vo pra{awe zakon, pravilnik, uredba, odluka ili nekoj drug podzakonski akt koj e podlo`en na usoglasuvawe so evropskoto zakonodavstvo.

3. Usoglasenost na predlogot na propisot so odredbite na Spogodbata za stabilizacija i asocijacija me|u Republika Makedonija i Evropskite Zaednici i nejzinite zemji ~lenki i Vremenata spogodba za trgovija i trgovski pra{awa me|u Republika Makedonija i Evropskite Zaednici

a) odredba od Spogodbite koja se odnesuva na normativnata sodr`ina na predlogot na propisot

Se naveduva odredba, odnosno odredbi od Spogodbite, koja se odnesuva na normativnata sodr`ina na predlogot na propisot, se nazna~uva Glavata, odnosno Poglavjeto od Spogodbata kako i brojot na ~lenot. Dokolku Spogodbata ne sodr`i odredba koja se odnesuva na normativnata sodr`ina na predlogot na propisot izgotvuva~ot treba da go navede toj fakt i vo toj slu~aj ne gi popolnuva podto~kite b) do g).

b) vo koj stepen so predlogot na propisot se ispolnuvaat obvrskite koi proizleguvaat od navedenite odredbi od Spogodbata

Se naveduva vo koj stepen so predlogot na propisot se ispolnuvaat obvrskite koi proizleguvaat od navedenite odredbi od Spogodbata. Izrazi koi pritoa treba da se koristat se: “ ispolnuva vo potpolnost”, “delumno ispolnuva” i “ne ispolnuva”.

v) pri~ini za delumno ispolnuvawe odnosno neispolnuvawe na obvrskite koi proizleguvaat od navedenite odredbi na Spogodbata

Dokolku obvrskata samo delumno se ispolnuva ili voop{to ne se ispolnuva, izgotvuva~ot e dol`en da go navede pri~inite bez ogled dali se vo pra{awe stopanski, finansiski, socijalni ili nekoi drugi pri~ini. Pritoa mora da se povika na odredena analiza na procenka na vlijanieto, studija ili nekoj drug dokument, a ne samo voop{teno da gi navede pri~inite. Isto taka e dol`en da navede vo koj rok ima namera da ja izvr{i obvrskata vo potpolnost.

g) vrska so Programata za pribli`uvawe na nacionalnoto zakononodavstvo so zakonodavstvoto na EU

Se naveduva dali dadeniot propis e predviden vo Programata za pribli`uvawe na nacionalnoto zakonodavstvo kon zakonodavstvoto na EU. Vo toj slu~aj se naveduva brojot na propisot. Isto taka neophodno e da se navede dali pri donesuvawe na propisot e po~ituvan rokot predviden so Programata, nekoj drug dokument, kako i samata Spogodba. Ako rokot ne bil po~ituvan izgotvuva~ot e dol`en da gi navede koi se pri~inite za nepo~ituvaweto na rokot.

4. Usoglasenost na predlogot na propisot so zakonodavstvoto na Evropskata unija

a) odredbi od sekundarnite izvori na pravoto na EU

Se naveduvaat odredbite od sekundarnite izvori na pravoto na EU koi se odnesuvaat na normativnata sodr`ina na predlogot na propisot i stepenot na usoglasenosta na predlogot na propisot so navedenite odredbi.

Sekundarni izvori na pravoto na EU se akti koi se delat na zadol`itelni (regulativi, direktivi, odluki) i nezadol`itelni (preporaki, mislewa). Usoglasuvaweto na zakonodavstvoto se vr{i soglasno zadol`itelnite akti, a nezadol`itelnite treba da se zemaat vo predvid. Vo ramkite na Zaedni~kata nadvore{na i bezbednosna politika i Sorabotkata vo oblasta na pravosudstvoto i vnatre{nite raboti vo EU se donesuvaat akti od drug karakter (ramkovna spogodba, odluka, zaedni~ki stav, zaedni~ko dejstvuvawe, zaedni~ka izjava, zaedni~ka strategija, izjava, zaklu~ok, konvencija).

Pri popolnuvaweto na ovaa to~ka potrebno e da se navede poln naziv na aktot, kako vo prevodot na makedonski jazik, taka i vo prevodot na angliski, so naveduvawe na vidot na aktot, oznakata na instituciite/institucijata na EU koja go donela, negoviot broj, brojot na Slu`beniot vesnik na Evropskite zaednici (Official Journal- OJ) vo koj e objaven i negovata oznaka vo CELEX bazata na podatoci.

Pri naveduvawe na stepenot na usoglasenost treba da se nabrojat EU merkite so koj predlogot na propisot se usoglasuval i do sekoja merka da se navede oznakata na stepenot na usoglasenost. Oznakite koi se koristat se slednite:
1. “potpolna usoglasenost” – predlogot na propisot e vo soglasnost so odredbite na sekundarnite izvori na pravoto na EU, usoglasen e so site na~ela koi proizleguvaat od tie odredbi ili gi transponira site odredbi od sekundarnite izvori na pravoto na EU
2. “delumna usoglasenost”- predlogot na propisot e vo soglasnost so odredbite na sekundarnite izvori na pravoto na EU, no ne e usoglasen so site tuku samo so odredeni, najva`ni na~ela koi proizleguvaat od tie odredbi i so toa ne e potpolno vo soglasnost so odredbite od sekundarnite izvori na pravoto na EU. Vo ovoj slu~aj treba da se nabrojat na~elata od sekundarnite izvori na pravoto na EU za koi postoi usoglasenost.
3. “neusoglasenost” - predlogot na propisot e vo sprotivnost so odredbite na sekundarnite izvori na pravoto na EU.

v) pri~ini za delumna usoglasenost ili neusoglasenost so zakonodavstvoto na Evropskata unija

Dokolku predlogot na propisot e samo delumno usoglasen so izvorite na pravoto na EU ili e neusoglasen so niv, izgotvuva~ot e dol`en da gi navede pri~inite, bilo da e vo pra{awe stopanska, finansiska, socijalna ili nekoja druga pri~ina. Pritoa mora da se povika na odredena analiza na ostvaruvawe, studija ili nekoj drug dokument, a ne samo voop{teno da ja navede pri~inata. Isto taka treba da navede i vo koj rok ima namera da postigne potpolna usoglasenost.

g) rok vo koj e predvideno postignuvawe na celosna usoglasenost na predlogot na propisot so zakonodavstvoto na Evropskata unija

Izgotvuva~ot treba da go navede rokot koj e predviden so Spogodbite, Programata za pribli`uvawe na nacionalnoto zakonodavstvoto kon zakonodavstvoto na EU ili vrz osnova nekoj drug dokument za postignuvawe potpolna usoglasenost na predlogot na propisot so zakonodavstvoto na Evropskata unija i da se nazna~i dali usoglasuvaweto e sprovedeno vo zadadeniot rok. Dokolku usoglasuvaweto ne e sprovedeno vo rokot, izgotvuva~ot treba da gi navede pri~inite za nepridr`uvawe kon rokot.

More specifically, The Economist released its latest Big Mac Index, a simple, lighthearted and popular indicator of whether currencies are valued correctly. The idea, according to the newspaper, is this: The price of a Big Mac captures a lot of what's going on in a given economy, from labor to rent to the price of produce. Since Big Macs are just about the same in most countries, they should, according to the economic theory of purchasing power parity, cost about the same when converted into the same currency. "Since a Big Mac costs 48 kroner ($7.76) in Norway and only $4.80 in America, the kroner is overvalued by 62 percent according to this lighthearted, protein-rich analysis, making it the most puffed-up currency in the index," The Economist offered by way of example. In Israel, the cost of a Big Mac in 2014 is NIS 17.50, which at the NIS 3.41 exchange rate comes out to $5.13. For outsiders, for example economic students, who do not have a clue what these terms mean, economists’ terminology is exclusionary. It makes economists the gatekeepers of economic ideas. Economists’ terminology serves as a barrier to entry, restricting the supply of economists, and increasing the value of the services provided by existing economists. Which of these two reasons is the strongest?
