...Ebony Law/531 November 2, 2015 Aaron Gershonowitz In the case of “You the Judge” The defendant was under the assumption that he was denied a promotion due to actions of his coworker the plaintiff because of an inappropriate screen saver that was sent to his computer. In the defense of the defendant this screensaver was completely inappropriate and the behavior from his coworker was not professional by any means and due to those actions alone she should have been reprimanded or even fired if it could have been proven that she was the one that sent the screensaver. The defendant also stated in his argument that he often participated with other members in the office when they joked around about things that were not work appropriate. The judge’s decision was made very easily due to evidence and the defendant’s testimony. The evidence showed what the employee’s job description was and what is expected of them as employees along with guidelines for any sexual harassment that may been seen or expected. The defendant basically shoot himself in the foot by not reporting any of the incidents that occurred in the workplace. When the initial incident occurred he should have reported the employees and the appropriate actions would have been handled by management. Under the Common Law, everyone is individually responsible for their own actions. The 'office' they may hold, the 'authority' they may consider they have, and/or the uniform they may wear, does not protect them in any way, shape, form. Simply because they (like everyone else) are responsible for every action they take. This was set into tablets of stone following Word War II, at the Nuremberg Trials. German Officers claimed "I was only obeying orders", yet they were still found guilty, and hung accordingly. This also forms a part of the Geneva Convention to which most Countries are signatories, especially the United Kingdom. Thus "I was only obeying orders" is not a defence. The reasoning is simple: BEFORE taking any actions against anyone else, make sure that what you are doing is lawful and moral. If you suspect that the action you have been ordered to take is either unlawful or immoral, then you must refuse to obey. You can report the order, and your reasons for believing it to be unlawful and/or immoral to a higher authority. You can go as high as you like in the chain of authority, pointing out that anyone who conspires to support the unlawful/immoral order are making themselves accomplices, in Law. One reason I place My Cousin Vinny under the theme of legal education is that it provides so much material you can use in the classroom. For example, you can use the movie to discuss criminal procedure, courtroom decorum, professional responsibility, unethical behavior, the role of the judge in a trial, efficient cross-examination, the role of expert witnesses and effective trial advocacy. Go here, here and here for more on this. But the reference to legal education goes deeper. I think you can use the movie to discuss the most common topic of debate within legal education itself. Interestingly, however, in My Cousin Vinny, the issue is turned on its head. After Vinny’s girlfriend Mona Lisa bails him out for a second time after having been found in contempt, she criticizes his performance in court and tells him it is pretty clear he does not know what he is doing. She then utters one of my favorite lines in the movie: “Don’t they teach you that in law school?” Vinny’s response is just as classic: “NO! They teach you Contracts...! Obviously, the implication is that in law school they teach "law" not "how to practice law"....
