1. Hvad er et løfte?
Et løfte er en ensidig erklæring fra en person om at ville påtage sig en pligt. Løftet skaber forventninger hos modtager og er derfor bindende, når modtager læser eller hører det (kundskabsøjeblikket)

2. Hvad er en accept?
En accept er et svar, hvori man siger ja til et tilbud. Accepten er både et løfte, der binder acceptanten, når modtageren har læst eller hørt det (kundskabsøjeblikket) og et påbud, der binder modtageren, når det er kommet frem (modtaget)(brevsprækkeøjeblikket)

3. Forklar aftalemodellen?
Aftalemodellen består af 2 tilbud og accept.
Hvis accepten er rettidig og overensstemmelsen.
Aftalen er mellem løfte giver og løfte modtager.

Løftegiver sender tilbuddet til løftetager. Når Løftetageren så har modtaget tilbuddet (brevet) er fremsendelsestiden slut. Derefter kommer brevsprækkeøjeblikke og det er først når løftetageren åbner brevet og får kundskab til tilbuddet er tilbuddet bindene da det først er der hvor han kender til tilbuddet. Derefter tænker løftemodtager om han vil accepter tilbuddet eller om han vil afvise tilbuddet. Hvis løfte modtagerne så accepter tilbuddet kan man nu kalde ham for accepten og der vil nu være en bindene aftale når løftegiverne får kendskab til det accepteret tilbud.

4. Hvad forstås ved den legale acceptfrist?
Den legale acceptfrist beregnes som tiden for fremsendelse af tilbuddet + en rimelig betænkningstid + tiden for returnering af svaret

5. Hvordan kan et løfte tilbagekaldes?
Hvis en tilbudsgiver fortryder sit tilbud, er der mulighed for, at tilbuddet kan tilbagekaldes. Dette kan ske hvis tilbagekaldelsen "kommet frem" (brevsprække-øjeblikket) inden eller samtidig med tilbudsmodtagers kundskab til tilbuddet.

6. Hvornår er et løfte tilbagekaldt?
Et løfte er tilbagekald når tilbagekaldelsen er sket inden tilbudsmodtageren kender til tilbuddet og dermed ikke har kendskab til tilbuddet. Hvis tilbudsmodtager allerede kender til tilbuddet kan man ikke tilbagekalde tilbuddet.

7. Hvad sker der, når en accept er forsinket?
Det fremgår af reglen, at en forsinket accept som hovedregel vil blive betragtet som et nyt tilbud. Den oprindelige tilbudsgiver skal acceptere for, at en aftale vil være indgået.

8. Hvad er konsekvensen af, at en accept er uoverensstemmende?
Som hovedreglen er, at en uoverensstemmende accept er et afslag, selv om acceptfristen endnu ikke er udløbet. Den uoverensstemmende accept vil blive betragtet som værende et mod bud (nyt tilbud) fra acceptantens side.

9. Giv eksempler på ”opfordring til at gøre tilbud” 10. Hvornår er et tilbud sendt på mail bindende?
Et tilbud som er sendt på mail er bindene når tilbudsmodtageren har kendskab til mailen og dermed ved at der ligger et tilbud på hans mail.

11. Hvad er en standardkontrakt?
En standardkontrakt er det stykke papir man skriver under på når man laver en aftale problemet ved disse kontrakter er at man som oftest ikke læser det med småt og dermed skriver under på noget som man ikke ved.

12. Hvad er en international aftale?
Ved en international aftale forstås en aftale indgået mellem 2 parter, der har sit forretningssted i hvert sit land.

13. Hvornår er et tilbud bindende i henhold til CISG
Når tilbudsmodtageren modtager tilbuddet, får det virkning for tilbudsgiveren. Det vil sige, han er bundet af indholdet af tilbuddet. Der er ikke et krav til, at tilbudsmodtager skal have fået kendskab til tilbuddet, men det skal være modtaget.

14. Hvornår er en accept bindende for tilbudsmodtager (acceptanten) i CISG?
Hvis tilbudsmodtageren ønsker at sende en accept, skal det ske inden acceptfristens udløb.
Acceptfristen kan være angivet i tilbuddet. Accepten skal så være kommet frem til tilbudsgiver inden den fastsatte frist. 15. Hvad er forskellen på et genkaldeligt og uigenkaldeligt tilbud i CISG? 16. Hvornår kan et genkaldeligt tilbud og et uigenkaldeligt tilbud tilbagekaldes?

Da Hansen ikke skriver hvilken dag tilbuddet senest skal besvares, kan Graversen få ret i sin påstand om, at der er indgået en bindende aftale, og dermed skal Hansen sende vare til Graversen.

Da det spanske firma sender deres accept hvor priserne ikke er de samme som Gudenådalens Bryggeri har tilbudt kan accepten på ingen måde godkendes og aftalen er ikke godkendt og bindene.
5.9 Checkspørgsmål til forbrugeraftaler

1. Hvad forstås ved en forbrugeraftale?
En aftale, der indgås mellem en forbruger og en erhvervsdrivende, der sælger varen som led i sit erhverv.

2. I hvilke situationer gælder forbrugeraftaleloven?
Ved en forbrugeraftale forstås i denne lov en aftale, som en erhvervsdrivende indgår som led i sit erhverv, når den anden part (forbrugeren) hovedsagelig handler uden for sit erhverv.

Stk. 2. Den erhvervsdrivende har bevisbyrden for, at en aftale, den pågældende har indgået, ikke er en forbrugeraftale.

Stk. 3. Under i øvrigt samme betingelser som nævnt i stk. 1 finder loven tillige anvendelse på aftaler om varer og tjenesteydelser fra ikkeerhvervsdrivende, hvis aftalen er indgået eller formidlet for sælgeren eller tjenesteyderen af en erhvervsdrivende, og på erhvervsdrivendes henvendelser med henblik på indgåelse af sådanne aftaler.

3. Hvad menes med ”uanmodet henvendelse”?
Uanmodet henvendelse er når man bliver henvendt til uden man har bedt dem og at kontakte en eller accepteret nogle betingelser som at de må ringe til en.

4. Hvad forstås ved negativ aftalebinding?
Negativ aftalebinding, er når en erhvervsdrivende uden forudgående anmodning sender varer til forbrugere med anmodning om, at de sendes tilbage, hvis modtageren ikke ønsker at beholde dem. Dette er ikke tilladt, og forbrugeren har ikke pligt til at returnere fejlagtigt fremsendte varer.

5. Hvor lang er forbrugerens fortrydelsesret?
Som hovedregel er der ikke fortrydelsesret, når en aftale er bindende indgået. Det er en undtagelse, at der i forbrugeraftaleloven er en fortrydelsesret, når aftalen indgås på visse særlige måder, fx på internettet. Dog giver de fleste virksomheder 14 dages fortrydelsesret selvom dette ikke er et krav.

6. Hvor lang tid har forbrugeren til at sende varen tilbage?
14 dage

7. Hvem skal betale tilbage sendelses omkostningerne?
Som udgangspunkt skal forbrugeren selv betale tilbage sendelses omkostningerne men flere og flere virksomheder betale dette i dag da dette er en ekstra service.

8. Hvor lang er leveringstiden ved forbrugeraftaler?
Den erhvervsdrivende skal levere til den aftalte tid og senest 30 dage efter aftalens indgåelse. Hvis f.eks. den erhvervsdrivende skriver, at der vil være 5-7 dages leveringstid på deres hjemmeside, skal varen leveres inden for den aftalte periode

9. Hvad er den sikreste måde at betale på ved fjernsalg?
Den absolut sikreste måde er at bruge kreditkort f.eks. Visa, MasterCard m.m.

10. Hvor lang opsigelsesfrist er der på et abonnement?
Alle løbende aftaler kan som hovedregel opsiges efter 5 måneder med 1 måneds varsel til udgangen af en måned. Det vil sige at en person kan være bundet af en løbende aftale i mindst 6-7 måneder.

Ifølge forbrugeraftaleloven § 4 må en erhvervsdrivende ikke kontakte en forbruger i forbrugerens hjem eller på arbejdspladsen for at indgå en aftale.

The signalman confides to the narrator that he has seen some disturbing sights that he believes are ghostly apparitions. The story reflects the narrator's initial skepticism, which turns to horrified belief at the conclusion. The story opens as the narrator is taking a walk in the country. He sees a signalman by the train track at the bottom of a steep cutting. He calls to the signalman, makes his way down a zigzag path to the track, and converses with him. ...The Elephant Man Name English 225 Introduction To Film Instructor: Name Date The film “The Elephant Man” is an iconic and powerful humanistic filmmaking endeavor. Director David Lynch forces the horrors and sadness of deformity onto the audience in a way that leaves the viewer tear choked with sadness and sympathy. Most people who watch the film are touched in a way that alters their view of the crippled, weak, and deformed persons of the world. The creation of the film begins with Joseph Merrick’s incredible story being written into a play by Bernard Pomerance in 1979. This play is still performed from time to time. Lynch’s film version was released the following year, but was not derived from the play but did give Lynch his inspiration. Lynch based his film version of Merrick’s life on various biographical sources most of which were Merrick’s own words in his memoirs. The script, written by Lynch, contains information based upon Merrick’s memoirs and biography, as well as from Frederick Treves’ personal accounts. As far as historical accuracy is concerned, certain details have been altered to make the story suitable for film. For example, Merrick is referred to incorrectly as “John“. This inaccuracy is however, a perpetuation of the error that was made in history according to Frederick Treves’ account of the story.
