#1) Driver was responsible for the spill and he should have immediately called 911, notified Big Joe to report and seek assistance regarding what actions he should take.
#2) STB placed the batteries on pallets as we would normally do for all of our local customers, but it’s the driver’s complete responsibility to make sure that before he drives off that his cargo is properly loaded on board, secured (wedged and blocked), and ready for transport.
#3) Your driver should not have signed the document (invoice) if he wasn’t satisfied with our pallets or how they were loaded on the bed of the truck. It is a fact that ownership and all responsibility for goods transfers to the driver (Big Joe, in this case) at the moment he signs the receipt for the goods (Invoice) bears all responsibility of the safe transport of the shipment from that point on.
