Vedic way to eradicate corruption
LONG AGO A NASTY REPORTER CONFRONTED THE Indian Iron Lady, Indira Gandhi, who had dismembered Pakistan, with the rampant corruption at almost all levels of administration. Indeed indirectly she shouldered the responsibility of overseeing the governance of a big nation with a large and diverse population. She deftly brushed aside the loaded question by a swipe of her hand accompanied by a short sentence that Corruption was a global phenomenon. How true and how false. Undoubtedly large amounts of cash changed hands in big offices in Japan for granting favours illegally and resigning when caught in the act. Same was the case with the developed countries of the West. But India walked away with the cake in being submerged inb corruption from top to toe in all walks of life.

How is it now, one may ask. Well, the situation on the corruption front has gone from bad to worse. Now under the present regime at the Centre, headed by the same Congress party to which Indira Gandhi belonged, there is a scam a day, There is hardly a Minister of the government who is not directly or indirectly involved in a scam. So, no one can claim that he or she is more pious than the Pope. No one is in a position to exercise the right of throwing the first stone at the sinner because all are sinners and sailing in the same boat.

WHAT IS CORRUPTION

The dishonest or illegal behavior of people in authority for granting favours for a consideration is termed as corruption. Accepting bribes for doing an illegal act or omission to do so may also be called a corrupt act. When many senior officials and ministers make money under the table for allotting coal fields, granting licenses to do something legal but in an illegal manner, the whole transaction might be termed as an illegal act and the regime would carry the tag of corruption. As of now, corruption is a way of life in India that is Bharat. If an act or omission amounting to a corrupt practice is out in the public domain, there is a lot if mud slinging and calling names. Right now we are passing through that phase of public life where political correctness demands that one who wishes to make progress and let his business flourish must keep his mouth shut and purse strings loosened.

The Common Man or the AAM AADAMI in conversational language is the worst sufferer and sees no light at the end of the tunnel. It is for his and her good that you and I have to work now. The common remedy may not be effective to cure this uncommon malady and we must think of something different, something spectacular. We may have to go back a thousand light miles away to the ancient period of history when life was so simple and man breathed fresh air that was free from pollution. Above all the word Corruption had not found a place in the vocabulary of men, women and children. Life ambled along and people remained in the comfort zone both inside the house and outside too. Great.

THE DIVINE LIGHT

Our Divine Father, ISHWAR, had shown the way of the VEDAS to lead us and help us walk on the path of righteousness. Maharishi Swami Dayanand Saraswati has mentioned many a time in his treatises as well as the magnum opus, Satyarth Prakash that the Vedas were revealed by the Param Pita Parmatma to four Rishis right at the beginning of the present human Creation. Rigved, Yajurved, Samved and Atharvaveda were revealed to Rishis named Agni, Vayu, Aditya and Angira respectively. Life was good. The Vedas guided one and all irrespective of their caste, creed, region or religion.

So far so good. Nevertheless we all know what goes up in the sky is bound to come down. The Vedic way of life too ran into hurdles and roadblocks due to internal strife, clash of cultures and new emerging way of life in remote islands. Minor strifes gave way to major civil wars where one fought against one’s own kith and kin. In India a war of great magnitude was the Mahabharat between royal cousins called Pandavas and Kauravas. The Great War caused unt0ld suffering and the knowledge emanating from the Vedas receded in the background. Semi-literate priests and purohits took over reins of religion and misinterpreted the mantras leading to travesty of Truth.

Mr Ignoramus even deprived the women folk from becoming priestesses and snatched the right to read the Vedas. By and by women suffered and turned into illiterates immersed in superstitions. It took centuries to bring them back on rails. It was Swami Dayanand Saraswati, born in 1824 at village Tankara in Rajkot, Saurashtra who restored to women their lawful rights to read the Vedas and become High Priestess again. Gurukuls were opened for both boys and girls to let them have the benefit of the Vedic education to counter the bad influence of education imparted by schools of East India Company. Sir Ramsay Mcdonald, then Leader of Opposition in the House of Commons and later Prime Minister of the United Kingdom, who visited Gurukul Kangri paid rich tributes to Mahatma Munshi Ram, later Swami Shraddhanand, for answering Macaulay’s Minutes in a pragmatic way.

The graduates of Gurukul were now ready to face the wrong doings in the society and establish the Vedic way of life. They vowed to uproot corruption and bring about Rule of Law. They took the burden of rooting out corruption from India that is Bharat and let all citizens live a life of honesty.

DEMON DOMINATES AGAIN

The year 2012, the period of our exchange of views in the International Arya Mahasammelan in Rohini, Delhi. The demon of corruption has raised its head again. The hydra-headed monster is all pervasive. It is here, it is there and it is everywhere. It will need the combined thought and action of Aryas from all over the globe to think f ile:///E:/Legal Aspects/Lawy ersclubindia Article Vedic way to eradicate corruption.htm 2/5

of a battle plan and attack the monster of corruption from more than one direction. It will be a multi-pronged attack to reduce the monster’s influence on the human society and finish it off in the second and final phase of decisive assault.

Corruption is dominating our society and the Vedic values of life are gradually receding into background. Why is it that the Ravan-like tendencies are dominating the thought process of our youth today? The Kans-like tendency to destroy the peace of common man is gaining strength. Why? In a nutshell one may say that the social set up of today is such that the Leader matters a lot. When the rest of the population emulates the Leader, it would be appropriate to reform the Leader and motivate him to lead the way for the rest of the human beings in that social set up.

YATHA RAJA TATHA PRAJA – the way the King or the Leader behaves, the led will follow in a devoted manner. In the good old days the King was guided by the Vedic values of life that he followed and his subjects emulated him. Unfortunately, the Vedic values of life stand fractured now. At present the new emphasis is on eating fast food, drinking alcohol, smoking and avoiding the company of cultured men and women immersed in the mantras that show the path of righteousness. When the leaders of men roam around with wives of others, abdicating his responsibility as a husband, as a father and head of his own family, the basic unit of society, the Family is destroyed leading to destruction of the society as such. It is the Head of the Family who has to eschew drinking alcohol, smoking cigarettes and abandoning drugs and grass. If he succeeds, his family will follow suit. Good behavior of the Head and generating Love as pure as that of a mother for her newborn baby, will lead to these good traits be accepted and practiced by others in the family and elsewhere.

SPIRITUAL STRENGTH

Spirituality is the panacea of all social ills, both major and minor. Right now most of the human beings are devoid of spiritual strength. Men and women pay a lot of attention to developing physical strength but pay scant attention to developing spiritual strength. While talking of Leadership, we in the Army always say and practice, “ Moral is to physical as ten to one”.In other words, if a leader has moral strength he will stand on a firm platform and inspire confidence among the led. What do we do to acquire the spiritual strength?

To begin with, have a firm and unshakable faith in Ishwar. When you face problems, go to God and ask Him for guidance. It will be forthcoming. One should go out in early morning for some fresh air, a wee bit of exercise and ,of course, Pranayam. When the like-minded people assemble in the morning, a short chat on a religious topic will be in order. Let this morning engagement be a regular feature not to be abandoned at the slightest pretext. Those who may be able to afford, chanting of Sandhya mantras and doing simple and short Havan will be in order. With this spiritual bent of mind, the devotee is bound to gain spiritual strength that would hold him in good stead when the chips are down. f ile:///E:/Legal Aspects/Lawy ersclubindia Article Vedic way to eradicate corruption.htm 3/5

Our next rung of the ladder on the path of progress should be Social Solidarity. To root out corruption, social solidarity will be a great deal helpful. In a mohalla matter, if all the residents are united, the municipal counselor dare not ask for a bribe to have a lawful work carried out. The overwhelming presence of the local residents in large numbers will be a deterrent to the corrupt official who will have no option but to turn the tail. Remember the phrase: SANGHE SHAKTI Unity is Strength. No wonder Bal Gangadhar Tilak, our great political leader and freedom fighter had introduced Social Ganesh Chaturthi to replace the individual one so that people meet each other and think about the movement to gain independence from the British overlordship.

KARMA AND KARMAPHAL

Let us beat the dr4um and announce from rooftops that the Vedic principle of Karma and Karmaphal is as relevant today as it was in days of yore. As a soul, I am free to act, act in bad faith or not act at all. Since my soul is free to act, it will indeed reap the harvest of our action. No other soul or individual is permitted to deputise for me and receive the Karmaphal, howsoever great or small he may be. The soul must act and besides acting in self interest must also act for public good too. The karmaphal will be given accordingly as a reward or as a punishment. Let it be clearly understood by one and all that in most of the cases Karmaphal is given in this life. Yogeshwar Shri Krishna knows all about it but we have to learn and imbibe this theory.

With a view to remaining firm in our Vedic belief, it is essential that we do not deviate from our decisions that we make. Remember you have pocket money but be a spendthrift and ask your father for money to be spent on buying teaching aids. Self-Discipline or Aatm-Anushasan is what the people must practice. Collectively the people will be well within their rights to ask for Clean Administration where no bribe is asked for and none is given.

It will be of interest to note that there is a United Nations Convention on Eradication of Corruption. The UN has put its seal of approval on confiscation of cash and kind, moveable and immoveable property of a corrupt official who is brought to trial and found guilty. The ill gotten wealth and the property bought thereof will revert to the State and cash,if any be deposited in the government treasury.

Thus it would be appropriate to prepare self for spiritual strength and unite the society mentally and physically for eradication of corruption from the human habitat.

...Loyola Law School (Los Angeles) Legal Studies Paper No. 2005-18 August 2005 Facilitating Compulsory Licensing under TRIPS in Response to the AIDS Crisis in Developing Countries Professor Hans Henrik Lidgard Professor Jeffery Atik This paper can be downloaded without charge from the Social Science Research Network (SSRN) electronic library at: http://ssrn.com/abstract=794228 FACILITATING COMPULSORY LICENSING UNDER TRIPS IN RESPONSE TO THE AIDS CRISIS IN DEVELOPING COUNTRIES Hans Henrik Lidgard and Jeffery Atik1 Abstract The AIDS crisis in the developing world has become a priority for international collaboration. The challenge is to find a balance between the acknowledged need to protect large investments expended in developing new medicines and the goal of providing essential medicines to poor countries. Patent protection must prevent undue infringement yet at the same time allow solutions to humanitarian needs. Is compulsory licensing a way out? TRIPS originally restricted compulsory manufacturing licenses to the country experiencing a public health emergency – which was of little utility to countries lacking manufacturing capacity. The Doha agreement effectively permits twinned compulsory licensing – a distribution and use license in countries experiencing a public health emergency and a manufacturing-for-export license in countries possessing appropriate manufacturing capacity. These changes make possible, at least in principle, a greater source of supply of generic pharmaceuticals...

Compulsory Licensing and Legal Issues in the Pharmaceutical Sector

...Introduction As the awareness and adoption of patents grows across the globe, we look to evaluate the consequences to society as a result of protection through patents. We will look at both sides objectively – the side of the inventor who has been granted exclusive rights to his/her invention and the other side – whether patents can deny basic social rights such as health to society. As we move further, we will look to understand a global framework (TRIPS) that provides guidelines on intellectual property regulations, the issue of compulsory licenses used by governments to circumvent patent protection and critically analyze specific cases where issuing compulsory licenses may be the need of the hour. What is TRIPS? TRIPS or Trade Related Aspects of Intellectual Property Rights is an agreement administered by the World Trade Organization (WTO). The agreement covers the following broad issues with respect to regulation of intellectual property (IP): • Basic principles that apply to intellectual property rights agreements • Protection to intellectual property rights • enforcement of intellectual property rights across member nations • settling disputes related to intellectual property rights between member nations A key objective of TRIPS is to provide a common set of international rules or guidelines to ensure protection of patents around the world. TRIPS is unique because it binds any country to its system of intellectual property protection if that country...

Amgen Strengths an Weaknesses

...Case Study 1 - Amgen Evaluate Amgen’s patenting strategy. What are its strengths, what are its weaknesses? Amgen is a multinational biopharmaceutical company, one of the world's largest biotechnology firms in the world. Amgen's first product was its breakthrough with recombinant human erythropoetin (EPO) as a treatment for anemia. It was crucial for the company to do all within its power to protect its intellectual property (IP). For this purpose Amgen's patent strategy included filling for three separate patents which would cover all its bases including the final product, starting material and the process. The first and most important patent the company filed was for the final product, recombinant human EPO. This patent is the strongest way to protect its IP as it prevents competitors producing, using, marketing, selling and importing the final product allowing exclusivity to Amgen. The drawback of this patent is the difficulty to achieve and sustain it. In order to receive a final product patent the company must prove that its product is innovative. If the final product has been described or published previously in any form this can be used as grounds to reject the request for the patent as it is considered prior art. Moreover it can be used to revoke the patent once received. Since EPO is a purified human protein most likely discovered previously in its naturally occurring form it will be very difficult for Amgen to patent it. The second patent that the company filled...

...Mr tedster Wayne Schuller managed a warehouse in Minnetonka, Minnesota. His major concern was the number of workers to assign to his single unloading dock. After he began contracting with motor carriers for deliveries, he found that they were assessing him stiff penalties if their trucks had wait time to be unloaded. Wayne started adding larger crews at the unloading dock, but often, they seemed idle because there were no trucks to unload. Wayne recalled from college that queuing theory might be applicable to such a problem. The theory of queuing is an analysis of the probabilities associated with waiting in line, assuming that orders, customers, and so on arrive in some pattern (often a random pattern) to stand in line. A common situation is that on the average, a facility may have excess capacity, but oftentimes, it is more than full, with a backlog of work to be done. Often, this backlog has costs associated with it, including penalties to be paid or customers who walk away rather than wait. If a firm expands its capacity to reduce waiting times, then its costs go up and must be paid even when the facility is idle. Queuing theory is used to find the best level of capacity, the one that minimizes the costs of providing a service and the costs of those waiting to use the service. After some further research specific to his firm, Wayne determined the following facts. 1. Trucks arrive randomly at the average rate of four per hour, with a deviation of plus or minus...

Patent Warfare

...The accuser may be more interested in developing newer and better versions of its product instead of getting a onetime payout. Collaboration will save both parties time and money by avoiding a long and expensive court case. It will also benefit both parties to share research and new ideas (Laudon, 2012). Nokia and HTC are a recent example of collaborations as they entered “into a collaboration agreement to provide access to each other’s patented technology to explore future projects” (Shankar, 2014). Working together will provide our business with new innovations making us more competitive. New innovations will develop an opportunity for new registered patents to our company, providing a defense system for possible future law suits. Licensing fees and royalties from new innovations will be collected by both parties creating new revenue. Avoiding court, continuing to grow and collecting revenue makes for a much more favorable scenario. Unfortunately most infringement lawsuits are made by patent trolls. They are companies created solely to hoard patents and using them for the purpose of getting a payout. They sue multiple...

...Queuing Theory Significance There is a very significant reason why Queuing Theory exists. Not only does it apply to a wide variety of topic, many within the business and supply chain industries, it also helps prove cause and effect. In addition to this, it provides a very logical idea of what a solution to a problem it has discovered should be. Measuring and understanding both order rate and service rate can potentially be the difference between business success and business failure. For example, if a company has too slow of a service rate, it is going to lose business because of the long wait times. On the opposite end of the spectrum, if a company focuses too much on improving its service rate instead of understanding its ratio compared to order rate, it will be misusing its very valuable resources. It is also important to have knowledge of all different types of queuing systems. Importance of Queuing Configuration As one can imagine, the importance of a queuing system configuration is very significant as well. As stated above, there are several different types of queuing systems and queuing configurations. If a business uses an improper queuing system or queuing configuration, it can suffer from one of many different negative consequences. Some examples of different types of queuing systems/queuing configurations are First Come First Served, First In First Out, Round Robin, Service in Random order, and many more. Queuing systems and configurations also vary by the number...

...August 2011 I realized recently that we may be able to solve part of the patent problem without waiting for the government. I've never been 100% sure whether patents help or hinder technological progress. When I was a kid I thought they helped. I thought they protected inventors from having their ideas stolen by big companies. Maybe that was truer in the past, when more things were physical. But regardless of whether patents are in general a good thing, there do seem to be bad ways of using them. And since bad uses of patents seem to be increasing, there is an increasing call for patent reform. The problem with patent reform is that it has to go through the government. That tends to be slow. But recently I realized we can also attack the problem downstream. As well as pinching off the stream of patents at the point where they're issued, we may in some cases be able to pinch it off at the point where they're used. One way of using patents that clearly does not encourage innovation is when established companies with bad products use patents to suppress small competitors with good products. This is the type of abuse we may be able to decrease without having to go through the government. The way to do it is to get the companies that are above pulling this sort of trick to pledge publicly not to. Then the ones that won't make such a pledge will be very conspicuous. Patent Trolls

...Patent Trolls Patent Trolls as defined by Investopedia is a term used to describe companies or people that misuse patents as a business strategy. These patents are bought by Non-Practicing Entity’s (NPE) who buy these patents from bankrupt companies and auctions and have no intentions of developing it. Their business strategy is to do some research and file lawsuits against infringing companies. These Patent trollers cost the US Company billions of dollars each year. They disrupt the productivities of many companies and affect the whole idea of creativity and innovation in the United States. Patent trolling cost the companies $29 Billion in 2011 in direct costs and up to $80 Billion in other ancillary costs. Add to that the incalculable costs in terms of productivity and disruption of innovation and entrepreneurship. Among the ones that are most affected by this are the small and start-up companies. To give a comparison, the terrorist attack of 9/11 had an economic impact of $123 Billion whereas, patent troll lawsuits amounted to $500 Billion in lost wealth to defendants. The next question that needs to be answered is why there is a rise in this sort of unethical business. This business has a very low start-up cost which usually requires buying out junk patents or acquiring patents from bankrupt companies. This business also has a very low overhead cost Furthermore, the cost of running these sort of businesses are very...

...What were some of the challenges that RIM faced to protect its intellectual property, and how did RIM handle those challenges? RIM’s success in the industry of wireless technology, more specifically, the e-mail wireless communications, made the organization’s intellectual property a prime target for adversaries that were not involved in the technological innovation industry, but for patent holding firms that were sitting in the background waiting patiently for a big fish to fall prey of their treachery. The success of these patent holding firms in the patent infringement litigation arena opened the gates for RIM’s industry competitors to scavenge from the patent holding company prey. Some of the challenges RIM faced to protect their intellectual property ignited a myriad of legal battles that wounded the Blackberry giant fatally from which RIM never recovered totally to this date. Below are summaries of litigation battles that originated after RIM, amongst other companies, decided to ignore a licensee contract agreement proposed by a Virginia based holding company in the year 2000. Ckc Case Write-Up

...C.K. Claridge, Inc. Case What are the interests of the various players in the Varacil market?
 * CKC: Obtain the least costly ending for the lawsuit, considering the future effects of the outcome with respect to market share and future profits. * Tolemite: Obtain a payment of all past and future liabilities at the highest royalty possible, or the highest payment. * BARD: They would benefit from two situations: 1.CKC wining the trial, as they would not have to pay royalties anymore, which could decrease CKC’s cost competitive advantage if BARD decides to lower the price of the product. Thus they can become more competitive and may increase their market share this way. 2. CKC having to pay a royalty of 4% or more. The same logic as above applies. What should Mr. Purcell do? If you think he should propose a settlement, what amount do you recommend, and how should it be communicated?
I believe Mr. Purcell should propose a settlement with Tolemite. The process started on 2005, and only in 2009 they are going to trial, which means 4 years of related costs, including time and monetary costs. Moreover, if they do go to trial, the process may continue, as appeals can be made if they win the case. This will mean more years with this problem in mind, and costly lawyers and advisors. By the time the trial is over, the patent will be close to expiring (2017), thus decreasing the importance of the trial itself. Regardless of the calculations made...

Starbucks Balanced Scorecard Analysis

...A monopoly can be defined as a market in which there is only one buyer. In the final section of intermediate microeconomics we have been discussing the impact that monopolies have on the competitive market. We have looked at how monopolies are able to charge a higher price for the products and services because they are the only seller in the market. One of the main goals of every company is to continue to gain market share over their competitors in order to increase shareholder profits and establish a solid foundation for a successful future. Firms that have established monopolies have a significant advantage to any company that tries to enter their market. Often times the cost of entering such markets blocks almost any firm from trying. As we will see, sometimes companies use patents as a way to block competitors from gaining market share. In an April 11, 2011 article written by John Scheller and Keneth Albridge III titled “The Patent Monopoly – more than a right to exclude,” they discussed how Google is using recently acquired patents in order to block competitors in the emerging cell phone technology market. The article says that many entrepreneurs often associate the value of patent rights with the ability to protect the patent owners position in a given market. They do this by demanding royalty payments from competitors or excluding them from the market altogether. Patents can also create value for firms by opening doors to other markets. Google recently acquired...

Unlike U.S. and EU courts, which have dealt with cases concerning calculating a FRAND royalty for a considerable time, Indian courts and the Indian antitrust authority—the Competition Commission of India (CCI)—have only just begun to decide such cases. In its initial orders in the first two antitrust complaints concerning SEPs, the CCI seemed to favor using the smallest salable patent-practicing component (SSPPC) as the royalty base to determine a FRAND royalty. However, in the short time since the CCI’s orders, the Delhi High Court has rendered contrary decisions in two SEP infringement suits. The Delhi High Court’s decisions use the value of the downstream product as a royalty base and rely on comparable licenses to determine a FRAND royalty. The Delhi High Court’s decisions are not only consistent with sound economic principles...

Home School vs. Public School

...Home schooled children are more advanced than children attending public schools. There are advantages to home schooling that can not be offered by public schools. The purpose of this paper is to bring awareness to some of the areas in which the statement , "Home-schooled" children are more advanced than children attending public schools, are supportive. Interest in this topic mainly are generated due to the decline in the public school system. As a parent of a current ninth grader I am saddend by the issues that children have to deal with in order to receive public education. Home schooling is defined as, ‘an education that is provided outside a ‘normal' school environment’. This type of education has undergone numerous debates, raising questions as to whether or not it is an effective educational program. Many people are equally divided between the pros and the cons, with people arguing that home schooling offers many benefits for children and others arguing that it affects children’s social skills and education. If the opportunity arose home schooling is an option I would consider home schooling for my current student.
