The main purpose of having what we know to be called Law in place is to help protect the people as a whole. It is to provide the necessary protection and give out legal penalties if someone was to break the laws. The purpose and main for a protective order is to protect someone from harm of another individual. It helps those that may be in harm of sexual, physical, mental abuse, stalking, harassment as well as those that have issues with neighbors’. Pretty much a protective order is put in place to help citizens be protective of any form of abuse by anyone. According to (findlaws) protective orders are court-ordered documents that require the person named in the order to stay away from for a particular distance of the individual filing. Protective also known as a “restraining order” as well, and is commonly used to keep away abusive spouses and even family that may feel their life is in danger of someone.
In Indiana under code sec. 34-26-5-1 you can find their rules and requirements for a protective order and the requirements and eligibility of an order. In Indiana the duration of an individual that has been placed on an order is 60 days maximum for an emergency and maximum 1 year which can be extended out for an additional 1 year. I totally disagree with that law because honestly someone that has to get arrested should be on protective custody order from a victim for the rest of their life. There has been a number of women who has had protective orders against a spouse and once they are out when the order expires has cost them their lives. According to (AM J Public Health.2004 April; 94(4):613-618) the longer the times someone receives the lower the numbers get when concerning domestic violence.
In the state of Indiana it states that the person or member of the petitioner’s household can apply. I disagree with
