Parties Involved in the Case The plaintiffs were the Mexican –American parents of children attending the Edgewood Independent School District, represented by Rodriguez brought a lawsuit against the San Antonio Independent School District (i.e. the defendant). (Oyez, 2015)
Date and Place Where the Case Was Tried On October 12, 1972, the trial took place in San Antonio, Texas at a Federal district court (Cornell University Law School, 2015).
The Facts of the Case Texas legislature enacted the Texas Minimum foundation School program to resolve inequality in the funding and quality of school districts (Cornell University Law School, 2015). The program aimed to utilize state and local funds for school district expenses (Cornell University Law School, 2015). Individual school districts in Texas were mandated to provide 20 of the revenue to the fund the program (Cornell University Law School, 2015). The revenue was collected from the property value taxes of citizens living in certain school districts (Cornell University Law School, 2015). …show more content…
Specifically, Rodrigues’s school district contained property values that were significantly lower than other Texan school districts (Cornell University Law School, 2015).. Thus, students in Rodriguez’s school district resided in areas of low property value (Cornell University Law School, 2015). The discrepancy in Rodriguez’s school district caused lesser revenue being collected per student for educational expenses (Cornell University Law School, 2015). Furthermore, the discrepancy allotted more revenue to educate students that attended districts in wealthier areas. Rodriguez claimed the discrepancy in revenue collected in school districts violated the students’ rights in the Equal Protection Clause of the Fourteenth Amendment to the Constitution (Cornell University Law School,

...Introduction Bangladesh with its poverty stricken economy coupled with large population base has no choice but to transform its people to skilled human resources through education, in general and higher education, in particular. As the cost of providing higher education has risen to a very high level, it is no longer possible for government to provide higher education to all. Due to budget constraints new universities cannot be established at government initiative. So the government of Bangladesh looked for private participation in this sector as a way out on the account of increased demand for higher education in the country and allowed private universities (PUs) to operate since 1992. However, the operations of PUs for last 13 years has been observed to produce mixed results. PUs could bring about some positive changes in the Higher education of the country in terms of increased capacity for higher education, politics-free environment and responsiveness. On the other hand, there are also serious allegations concerning high cost and poor quality of education in most PUs. The situation became so grave that a high power investigation team formed by the government had to put eight PUs in its black list and recommended for the cancellation of their license to operate as “University” in the country. Against this backdrop, the government opted for more stringent rules for the regulation of the PUs and accordingly preparing for the amendment of the existing Private University Act...

This four-year study investigates the effects of walking or stretching on the incidence of preeclampsia and reports on adherence to the intervention and on the secondary outcomes of changes in resting heart rate (HR), resting blood pressure and weight gain. Statement of the Problem The purpose of the study was to compare a walking exercise to a stretching exercise program during pregnancy in high-risk women who were sedentary and had previous history of preeclampsia. The problem was clearly stated and was a feasible researchable problem. The problem had significance for nursing and for the medical profession and might improve practice and education. ...Research Critique of “Adherence to Walking or Stretching, and Risk of Preeclampsia in Sedentary Pregnant Women” Introduction This paper is to critique a study of adherence to walking or stretching during pregnancy in high-risk women who were sedentary and had previously experienced preeclampsia. The purpose of the study was to compare a walking exercise to a stretching exercise program during pregnancy in high-risk women who were sedentary and had previous history of preeclampsia. This five-year study investigated the effects of walking or stretching on the incidence of preeclampsia and reports on adherence to the intervention and on the secondary outcomes of changes in resting heart rate (HR), resting blood pressure and weight gain (Yeo, 2009). Statement of the Problem The problem was clearly stated and was a sufficient researchable problem. The researcher does a good job of stating why the problem is important, but there was no mention of the number of people who are affected by preeclampsia and complications of the disease itself. Yeo (2009) identifies the following research question for this study as: 1. Will previously sedentary pregnant women adhere to an exercise program for 40 minutes a day 5 times a week in the latter half of pregnancy (Yeo, 2009)? 2. Is there a difference in adherence to a walking program or a stretching exercise program (Yeo, 2009)? 3. How does adherence to walking or stretching change with the advance of pregnancy (Yeo, 2009)...

Business Law

...Alternative dispute resolution (ADR) (also known as external dispute resolution in some countries, such as Australia[1]) includes dispute resolution processes and techniques that act as a means for disagreeing parties to come to an agreement short of litigation. It is a collective term for the ways that parties can settle disputes, with (or without) the help of a third party. Despite historic resistance to ADR by many popular parties and their advocates, ADR has gained widespread acceptance among both the general public and the legal profession in recent years. In fact, some courts now require some parties to resort to ADR of some type, usually mediation, before permitting the parties' cases to be tried (indeed the European Mediation Directive (2008) expressly contemplates so-called "compulsory" mediation; attendance that is, not settlement at mediation). The rising popularity of ADR can be explained by the increasing caseload of traditional courts, the perception that ADR imposes fewer costs than litigation, a preference for confidentiality, and the desire of some parties to have greater control over the selection of the individual or individuals who will decide their dispute.[2] Some of the senior judiciary in certain jurisdictions (of which England and Wales is one) are strongly in favour of the use of mediation to settle disputes.[3] Please read: a personal appeal from Wikipedia founder Jimmy Wales Read now Alternative dispute resolution From Wikipedia, the free...

Ethics Case Study

...Ethics Case Study Heather Holcomb University of Phoenix Ethics: Health Care and Social Responsibility HCS 335 Deborah Laughon RN BSN MS DBA January 23, 2012 Ethics Case Study Case Study Jerry McCall is Dr. William’s office assistant. He has received professional training as both a medical assistant and a LPN. He is handling all the phone calls while the receptionist is at lunch. A patient calls and says he must have a prescription refill for Valium, an antidepressant mediation, called in right away to his pharmacy, since he is leaving for the airport in thirty minutes. He says that Dr. Williams is a personal friend and always gives him a small supply of Valium when he has to fly. No one except Jerry is in the office at this time. What should he do? (Fremgen, 2009). Overview Health care providers are faced with making difficult ethical decisions everyday. Moral and value systems influence the ethical decision process, but the law and licensure regulations do as well. This case study is an example of a potential ethical dilemma and a possible breach of the law. The following questions will be explored: 1. Does Jerry’s medical training qualify him to issue this refill order? 2. Would it make a difference if the medication is for controlling high blood pressure that the patient critically needs on a daily basis? 3. If Jerry calls in the refill and the patient has an adverse reaction while flying, is Jerry protected from a lawsuit under the doctrine of respondent...
